<br /> <br />NOW, THEREFORE, Pursuant to the authority set forth in tFe <br />Colorado Open Mining Land Reclamation Act, the Land Reclamation Board of the <br />State of Colorado has determined that the following land stabilization and reclama- <br />tion procedures will be followed in the mining operation of Western in Section 22, <br />Township 3 North, Range 70 West, Boulder County, Colorado, and Western Hereby <br />agrees to faithfully perform the land stabilization and reci.omation work required <br />herein. <br />Air Pollution <br />Al. Western will monitor and control fugitive dust to keep same in <br />compliance with the dust emission standards set by the Colorado <br />Air Pollution Control Commission. <br />Blasting <br />B1. Blasting will be conducted during daylight hours only, and "n a <br />manner to alleviate or curtail shock and concussion nuisanc~° by <br />controlling the size of the blast. <br />General <br />G1. Daily operations will not begin before b. 00 A.M. nor extend past <br />10:00 P.M. <br />G2. Plan and agreement will be updated annually so that new techniques <br />can be utilized as they are produced or found. <br />G3. Western will furnish the Land Reclamation Board a performance <br />bond in the amount of Thirty Thousand Dollars ($30,000.00;1 to <br />insure that the work required herein will be accomplished. <br />Revegetation 8 Topsoil <br />R1. Wherever possible Western will stockpile and retain topsoil on <br />the property covered by this permit for future use on said property. <br />R2. Unless development plans are scheduled for a particular area within <br />a period of three (3) years after cessation of mining operations, <br />Western will grade and stabilize any surface area disturbed by <br />this operation and revegetate the area, following the best infortna- <br />Lion available from qualified organizations or persons. <br />-2- <br />
