~~~ • IIIIIIIIIIIIIIIIIII •~ <br />LAND RECLAMATION BOARD <br />Department of Natural Resources Cr,LG <br />Room 215, 1845 Sherman St. ~ ~ -~~ ~~ ~~~ <br />Denver, Colorado 80203 Telephone: 892-3401 <br />Land Stabilization and Reclamation Agreement <br />THIS AGREEMENT is entered into this day of , <br />1974 by and between THE STATE OF COLORADO, by and through its Director of <br />Natural Resources and the Land Reclamation Board (hereinafter referred to <br />as "State") and WESTERN PAVING CONSTRUCTION CO. (hereinafter referred to <br />as "Western"). <br />W I T N E S S E T H <br />WHEREAS, Western desires to operate a sand and gravel mirn~ <br />in Section 22, Township 3 North, Range 70 West, Boulder County, Colorado, <br />better known as the Weng Pit; and <br />WHEREAS, Western has submitted a plan on the Proposed Land <br />Stabilization and Reclamation Procedures for the proposed sand and gravel <br />mine operations; and, <br />WHEREAS, Said Weng Pit will be operated for the purpose of <br />extracting sand and gravel for commercial marketing and, <br />WHEREAS, The Colorado Open Mining Land Reclamation Act pro- <br />vides statutory authority for the Land Reclamation Board of the State of Colorado <br />to enter into agreements with operators or persons in charge of mining opera- <br />tions such as those contemplated by Western to insure that the necessary <br />stabilization and reclamation work will be done to prevent landslides, floods~x <br />erosion. This section of the law further provides that the Land Reclamation Beard <br />requires a performance bond conditioned upon faithful performance of the stairiliza- <br />Lion work required by the Board; and, <br />WHEREAS, The Land Reclamation Board has determined that the <br />mining operation to be conducted by Westem in said Section 22 could have ai adverse <br />effect on the environment and could result in landslides or erosion if proper stabiliza- <br />tion and reclamation procedures are not followed. <br />-1- <br />
