November 11, 2005 <br />Leonard Rice Engineers Page ,? <br />CDMG Reclamation Requirements <br />The following four rules listed by the Colorado Division of Mining and Geology <br />(CDMG) are referenced: _ ., ,_,_, _ „_ ,_~_ _ __ .._ ..~._ -. _ _ <br />• Timing: "All reclamation shall be carried to completion by the Operator with <br />all reasonable diligence, and each phase of reclamation shall be completed <br />within five (5) years from the date the Operator informs the Board of Office <br />that such phase has commenced, unless extended by the Board of Office. The <br />5-year period may be applied separately to each phase as it is commenced <br />throughout the life ofthe mine." Rule 3.1.3. <br />• Vegetation Cover: "In those areas where revegetation is part of the <br />Reclamation Plan, land shall be revegetated in such a way as to establish a <br />diverse, effective, and long-lasting vegetation cover that is capable of self- <br />,regeneration without continued dependence on irrigation, soil amendments or <br />fertilizer, and is at least equal in extent of cover to the natural vegetation of the <br />surrounding area." Rule 3.1.10(1). <br />• "The revegetation plan shall provide for the greatest probability of success in <br />plant establishment and vegetation development by considering environmental <br />factors such as seasonal patterns of precipitation, temperature and wind, soil <br />texture and fertility; slope stability; and direction of slope faces. Similar <br />attention shall be given to biological factors such as proper inoculation of <br />legume seed, appropriate seeding and transplanting practices, care of forest <br />planting stock and restriction of grazing during initial establishment." Rule <br />3.1.10(4). <br />• "To insure the establishment of a diverse and long-lasting vegetative cover, the <br />Operator shall employ appropriate techniques of site preparation and protection <br />such as mechanical soil conditioning by discing and ripping; mulching; soil <br />amendments and fertilizers; and irrigation." Rule 3.1.10(5). <br />Recommended Reclamation Conditions <br />• Replace trees and shrubs impacted by mining.at a minimum 1:1 ratio with <br />native species to emulate or improve on the wildlife habitat at the site and to <br />insure a diverse and long-lasting vegetative cover. <br />• To provide for the greatest probability of success in plant establishment, the <br />following requirements are recommended: <br />o Irrigate all trees and shrubs for a period of 2 to 3 years, or until self- <br />sustaining. <br />o Inoculate Mountain mahogany and other shrubs with appropriate <br />mycorrhiza to encourage growth <br />o Place topsoil from two to eight inches deep, with an average of 4 <br />inches. <br />o Rip all areas compacted during mining. <br />o Create natural contours, rather than a series of benches and cliffs. <br />Consultants in Natural Resources and the Environment <br />
