i • <br />EXHIBIT D -CONTINUED. <br />WATER RESOURCES <br />This mining operation will not disturb the prevailing hydrologic <br />balance of the effected land, as the land is presently being <br />used for meadow and grazing with surface irrigation. <br />The lessor own a part of the following Surface Water Rights: <br />Maxwell Creek <br />Anderson Ditch, Priority No. 12A. <br />Midway Ditch, Priority No. 111 <br />Cottonwood Creek <br />Cottonwood Ditch, Priority Nos. 15 and 43. <br />The third stage of this Placer Mining Operation will utilize <br />the existing Surface Water Rights as owned by the Lessor. The <br />proposed useage of these Surface Water Rights will have the same <br />100% return flow to the Arkansas River as the prior useage by <br />irrigation. <br />No water useage or discharge directly into or from the Arkansas <br />River is proposed, therefore, no NPDES Permit will be required, <br />in accordance and compliance with the State and Federal Quality <br />Laws. <br />VEGETATION. <br />The majority of the proposed Mining Area is presently in hay <br />meadow. The topsoil will be removed and stockpiled and used for <br />reclamation as needed after the project is completed. In the <br />main excavated areas the side sloped will be evenly sloped at not <br />less than a 2:1 slope, the bottom evenly drained, and left open <br />for future use as "Fish Ponds". <br />The aggregate stockpile areas and roads will be reclamation with <br />the stockpiled topsoil. <br />
