Your concerns are addressed in the order in which they were noted in your letter. 1. Two sets of the drawings indicating the stability of the rock base below the road after excavation of the fill material are attached. 2. Drawing 5-001 of the above drawings shows the relocation of the 36" CMP drainage pipe which directs water from the drainage ditch from the inside of the access road to MB No. 2. The pipe will be relocated as shown in the drawing. :. 3. WECC will apply to the Colorado Department of Health for a modification to its NPDES permit to allow for the dis- charge of water over the emergency spillway by June 1, 1984. A copy of the letter transmitting the application will be sent to CMLRD as well as a copy of the modified permit. 4. As discussed, the sedimentation pond was designed as a non-discharging pond. It is intended to dewater through the alluvium of the North Fork of the Gunnison River. If however for some reason the pond does not adequately dewater through the bottom, WECC agrees to pump the water out of the pond and discharge it into Sedimentation Pond MB 2. 5.
