As discussed and as delineated by the dotted line on <br />Attachment D to the revision, WECC will assume operational <br />responsibility for the area bounded on the south by the <br />upland diversion ditch, on the north by the outslope of <br />the berm between the stockpile and Bear Coal Company's <br />drainage ditch adjacent to the river, on the west by the <br />sedimentation pond and spillway constructed to control <br />runoff from the stockpile area and on the east by the toe <br />of the spoil stockpile. WECC will also be responsible for <br />reclaiming the road accessing the stockpile. <br />7. WECC will reclaim the stockpile area .and appurtenant <br />structures in accordance with the Mining and Reclamation <br />Plan for Bear Mines 1 and 2 and the revisions noted in <br />CMLRD's Findings Document of Compliance for Bear Mines 1, <br />2 and 3 dated May 10, 1982. That is, WECC will regrade <br />and rip the surface prior to reseeding. The area will be <br />revegetated with the seed mixture described in Table 10 to <br />the Bear Mines 1 and 2 Mining and Reclamation Plan. <br />Revegetation success will be determined as described in <br />• Bear Coal Company's Mining and Reclamation Plan for Bear <br />Mines 1 and 2 and as revised in CMLRD's Findings Document <br />of Compliance for Bear Mines 1, 2 and 3. Bonding calcula- <br />tions have been revised to reflect reclamation costs in <br />compliance with Bear's approved reclamation plan and are <br />attached. <br />8. The upland diversion ditch will be approximately 65 feet <br />from the toe of the backfilled Bear Portal No. 1 and <br />approximately 30 feet from.~the toe of backfilled Bear <br />Portal No. 2. <br />9. WECC's present Mining and Reclamation Plan indicates that <br />the area to be excavated for the second coal storage silo <br />will be backfilled and contoured. WECC intends to revise <br />its reclamation plan to reclaim the rock face below the <br />access road to its approximate original contour. Thus we <br />no longer intend to backfill that area upon reclamation. <br />This will be addressed in our response to CMLRD's mid-term <br />review of the Mt. Gunnison permit. <br />10. A discussion of calculations and delineations of the 100- <br />.year flood plain of the North Fork can be found in the Mt. <br />Gunnison Mining and Reclamation Plan at Section 2.8.1.7 <br />entitled "Flooding Evaluation". A letter from the highway <br />department is also attached indicating that their re- <br />channelling of the North Fork in the vicinity of the Bear <br />
