ORTEGA: Good afternoon Ladies and Gentlemen of the Board and thank <br />you for your interest in Colorado and preserving the best we have in terms of <br />beauty here in our beautiful state. And, thank you for your concern and <br />interest in this project. And I ended up with this sign-up sheet so I'll <br />justturn it in to the Board here, you folks here. So, ~ name is Prax Ortega <br />and am the Costilla County Local Emergency Planning Committee Chairman. This <br />is the only chairmanship I hold. <br />I'd like to pass to the Board, this January 20th letter that I sent <br />certified mail, to Mr. Gary Dodson, Battle Mountain Gold Company, in regard to <br />the San Luis Valley Six County Superfund Amendment Reauthorization, (SARA), <br />Act, Title III Act. In the process, we are asking Battle Mountain Gold to <br />contact this committee which was -- this committee was appointed by the State <br />• Commission of Emergency Response. So we are involved and for the past two <br />years I took this position of learning about SARA Title III and I have seen <br />many other emergency response plans. And this letter here, copy which was <br />sent out certified mail, was 30 days later, we didn't get no response from <br />Battle Mountain Gold Company and so we said maybe they are busy trying to <br />figure out the price of gold, if it is going up or down. That sort of upset <br />the committee. The county sheriff is on the committee, the fire department <br />chief is on the committee, I represent the committee as a Civil Defense <br />Director, and so we are sort of saddened that Battle Mountain is not the good <br />neighbor they claim to be. <br />On March 7, I sent another letter to Battle Mountain Gold Company, again <br />asking them to meet the SARA Title III requirements witfi the proper forms, not <br />th.ts emergency response plan that they have submitted. Excuse me for mU' <br />shakey voice. This second letter was addressed March 7, to Battlie Mountain <br />again, asking them by certified mail that we are request SARA Tide III <br />requirements - required data on extremely hazardous materials be addressed. <br /> <br />
