-39- <br />• We have -- there is under SARA Title III requirements, there is a facility <br />profile which I outlined in my January 20th letter and we also needed and <br />requested Material Safety Data Sheets as required by SARA Title III on each of <br />the extremely hazardous chemicals and acids. We haven't even seen one and <br />there is not no MSDS attached to this plan so we are greatly concerned as to <br />why we are being left out. <br />I went to the -- I am a volunteer fire department member, I went to the <br />monthly meeting, the Fire Chief did not have anything in terms of emergency <br />response plan. So that was last Tuesday. I'm the -- I requested this via <br />certified mail, I didn't get nothing. But yesterday, out of the Good Lord, <br />probability, drove me downtown to take my Dad to the VA Hospital first, but <br />the point is I ended up in the Mined Land Reclamation Division, Mr. Renner <br />gave me this emergency response plan, and I don't think it meet the SARA <br />Title III requirements that are required and set by the State Commission of <br />which we are only a leg as a local emergency planning committee. Me, the <br />sheriff and everybody else, but we are being left out so we don't think this <br />• plan here addresses a true emergency response situation so we are greatly <br />concerned about that. <br />In closing, I feel that Battle Mountain Gold Company should be required <br />to comply with the Colorado Emergency Planning Commission requirements. <br />That's what I have learned in my involvement with the commission. SARA Title <br />III laws should be, should also be required of this mining site application <br />because I guess that is why the Federal Government is trying to help local <br />communities under the SARA Title III Community Right-to-Know. And, I sent <br />this to Mr. Dodson, also, and this is the fact sheet of how the Federal <br />Government helps us, the state and local committees. So these are the type of <br />emergency response plans that the state is dealing with. And I talked to some <br />other emergency management directors and E1 Paso County gave me the format of <br />what forms we needed to send to Battle Mountain Gold Company with which they <br />did not comply. So it is just part of the team work I have had in involvement <br />as an emergency manager co-ordinator and I would respectfully request the <br />Board to not grant this application at this time until the proper emergency <br />response plan, as requested by the local emergency planning committee and the <br />
