• 4.05.16 Discharge Water into an Underground Mine <br />No surface water will be diverted or otherwise discharged into any <br />underground mine workings. <br />4.05.17 Post-Mining Rehabilitation of Sedimentation Ponds, Diversions, <br />Impoundments, and Treatment Facilities <br />No permanent sedimentation ponds, diversion ditches, impoundments, or <br />treatment facilities are planned; therefore, the requirements of this <br />Section do not apply to this application. <br />4.05.18 Stream Buffer Zones <br />Because of the compact nature of the facility location for the Bear No. <br />3 operation, it is necessary to encroach within the 100 foot zone of the <br />north fork of the Gunnison River. Although activities will be necessary <br />• within 100 feet of the river, the original stream channel will not be <br />moved by the Bear Coal Company. Furthermore, as shown on the Mine <br />Facilities Map (Map 10), special care has been taken to design diversion <br />ditches and sedimentation ponds to prevent any water quantity or quality <br />change from the surface activities of the underground operation. <br />Likewise, special care has been taken to provide for the reestablishment <br />of appropriate vegetation, both during and after mining. Therefore, no <br />adverse impacts on the north fork of the Gunnison River will be expected <br />from locating facilities of the Bear No. 3 Mine within 100 feet of the <br />river. <br />The Colorado Division of Highways is planning to relocate a portion of <br />the North Fork of the Gunnison River to facilitate highway construction. <br />This relocation will encroach the river even closer to the Bear Coal <br />Company operations, but the Colorado Division of Highways is planning <br />proper sedimentation control and revegetation practices to control <br />. erosion or sediment problems. <br />4.05-11 <br />
