The Bear Coal Company will <br />measure the quantity and quality of any discharge from the permit <br />area in compliance with the NPDES Permit. <br />The Bear Coal Company will report on discharge in accordance with <br />the Clean Water Act of 1977 under an NPDES Permit on a quarterly <br />basis; therefore, the Bear Coal Company will plan to use the <br />NPDES reports for filing with the Division. <br />Following the cessation of use of underground workings, Bear Coal <br />Company will continue to monitor surface water flow and quality <br />until determined that the reclamation has met the requirements of <br />Section 4.05, such that the disturbance has minimized any impact <br />to the prevailing hydrologic balance and the post-mining land <br />used has be attained. Equipment, structures, and other devices <br />necessary to measure and sample the quality and quantity of <br />surface water discharge will be removed when no longer needed at <br />the minesite. <br />4.05.14 Transfer of Wells <br />The Bear Coal Company does not plan to transfer any monitoring <br />well to water wells. <br />4.05.15 Water Rights Replacement <br />• The Bear Coal Company does not anticipate that any water supply <br />or water right of any owner of interest will be affected by the <br />mining operation. Both the C-Seam and the B-Seam workings have <br />been dry so the mining operatior. has not and is not expected to <br />impact any underground aquifers. <br />The Operator obtains water necessary for its underground mining <br />operation from the North Fork of the Gunnison River. Section 6, <br />Article XVI, Mining and Irrigation, of the Constitution of Colo- <br />rado, gives the Operator the right to divert the unappropriated <br />water of any natural stream for beneficial uses. If all of the <br />water in the No,th Fork of the Gunnison River is at any time <br />fully appropriated, then the Operator will have to cease pumping <br />from the river until there is again unappropriated water avail- <br />able. <br />• 4.05-10 <br />Revised June 29, 1990 <br />
