9.05.11 Groundwater Protection <br />As noted earlier in Section 2.04.7, there is no presence of any <br />groundwater in or above the area to be mined by the underground <br />operations other than perched systems which exhibit little lateral or <br />vertical continuity. Likewise, no acid-forming or toxic-forming <br />materials have been found to exist in the overburden or underburden of <br />the C-Seam or B-Seam Coal. <br />4.05.12 Protection of Groundwater Recharge Capacity <br />The reclamation plan, as described in Section 2.05.4, will return the <br />disturbed land to approximately the pre-mining condition; therefore, <br />groundwater recharge capability is expected to remain essentially the <br />same as the pre-mining condition. Also, because of the minimal existence <br />of groundwater in the permit area, the mining operation and subsequent <br />reclamation and sealing of the portals should have no adverse affect on <br />the existing groundwater recharge capabilities found in the area. <br />4.05.13 Surface and Groundwater Monitoring <br />The Operator will monitor groundwater as outlined in Section <br />2.04.7(1)(v). The current ground water monitoring plan is presented on <br />page 2.04-30b. <br />Stipulation No. 4 to the permit states: <br />THE APPLICANT SHALL CONTINUE TO SUBMIT TO THE DIVISION AN <br />ANNUAL REPORT OF INFLOWS, DISCHARGES AND CONSUMPTION OF WATER <br />WITHIN THE MINE. THIS REPORT WILL INCLUDE A MINE WORRINGS MAP <br />WHICH SHALL CONTAIN THE SOURCE (I.E., FAULT, FRACTURES, ETC.), <br />QUANTITY, DURATION, AND QUALITY OF MINE INFLOWS, AND A TABLE <br />CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED <br />IN THE MINE AND IMPORTED FOR USE WITHIN THE MINE WILL ALSO BE <br />INCLUDED. <br />The requirement in Stipulation No. 4 to submit a mine workings map is <br />hereby revised as follows: <br />A MINE WORKINGS MAP SHALL ONLY BE REQUIRED IF THERE ARE <br />MEASURABLE INFLOWS TO THE MINE DURING THE YEAR. ALL OF THE <br />INFORMATION REQUIRED BY STIPULATION NO. 4 SHALL BE SUBMITTED <br />WITH THE ANNUAL HYDROLOGIC REPORT. <br />A new Stipulation No. 32 is to be added to the permit which will <br />incorporate the revised Stipulation No. 4 language. Stipulation No. 4 <br />will be deleted from the permit as a result of the addition of <br />Stipulation No. 32. <br />The planned surface water monitoring plan includes monitoring required <br />under an NPDES Permit which was issued by the Colorado Department of <br />Health. Surface water monitoring locations are shown of the Mine <br />Facilities Map, (Map 10). Surface water samples will be analyzed for pH, <br />• 4.05-9 <br />Revised 6-24-93 <br />
