standards for the zone in which it is located. <br />1.7.2 Non-Conforming Structure, /ega/ shall mean a building or <br />portion thereof or other structure, which lawfully existed on the <br />effective date of these regulations, but since that time the <br />regulations have changed that would prohibit or limit the <br />construction of this structure due to current Zoning Regulations. <br />1.7.3 Non-Conforming Use, /eqa/ shall mean a use or activity <br />which was lawful prior to the adoption, revision, or amendment of <br />this Zoning Regulation but which fails, by reason of such adoption, <br />revision, or amendment, to conform to the present requirements of <br />this regulation. <br />1.7.4 Nursing Home (see health care facility) <br /> <br />1.7.1 Occupant shall mean the person occupying, or otherwise in <br />real or apparent charge and control of, a building or lot. <br />1.7.2 Occupied shall mean arranged, designed, built, altered, <br />converted, rented or leased or intended to be lived in. <br />1.7.3 Oi! and Gas Exploration and Production shall mean the <br />drilling, extraction, and transportation of subterranean fossil gas <br />and petroleum, and the necessary attendant uses and structures, <br />but excluding the refining, processing, or manufacturing thereof. <br />1.7.4 Open Space shall mean an area of land unobstructed from <br />the ground upward, or water, set aside, dedicated, designated, or <br />reserved for the recreation, scenic, or leisure use of the public or <br />owner of the property. <br />Gilpin County Zoning Regulations 29 <br />
