reserves the right to conduct an audit of Lessee's books and <br />records, at reasonable times and upon reasonable notice to Les- <br />see so as to not unduly hinder or interrupt Lessee's operations <br />or activities. Lessee shall not be obligated to furnish CFSI <br />with access to any interpretative data dealing with geologic <br />concepts and other such internal proprietary data, inforrr,ation <br />and -analysis. <br />11.2 Confidentiality. Each party agrees to treat all in- <br />formation acquired hereunder as confidential and hereby agrees <br />that it shall not use the name of the other party in any docu- <br />ment or press release or disclose any information it may obtain <br />hereunder to third parties or to the public without first hav- <br />ing obtained the written approval of the other party, which <br />approval shall not be unreasonably withheld, as to the form and <br />content of any such disclosure or release. <br />XII. LEASE AND DEVELOPMENT OF SURFACE <br />AND OF NON-LIMESTONE MINERALS <br />CF3I hereby reserves all rights to the surface of the Prem- <br />ises which are not needed for the Lessee`s operations hereunder <br />and excepts and reserves from this grant, the ownership and <br />development of all non-limestone minerals including oil and <br />gas, in, on and under the Premises; provided, however, that <br />CF&Z hereby covenants and warrants that any use of the Premises , <br />by CF&I or its successors, affiliates, lessees, licensees or <br />their respective heirs, executors, administrators, successors <br />or assigns, whether pursuant to a lease of the surface or of <br />any such non-limestone minerals or otherwise; shall not inter- <br />fere with Lessee's operations. <br />XIII. ASSIGNMENT <br />The provisions hereof shall extend to and be binding upon <br />the successors and assigns of CFI and Lessee. The rights and <br />obligations of either party hereunder may be assigned in whole <br />or in part, provided that the rights and obligations of Lessee <br />may not be assigned without the prior written approval of CF&I, <br />XIV.
