structures in Dlace, unless agreed to by C_°Si, and provided <br />further that Lessee shell not remove any D'.u lding, warehouse, <br />or eauipmer,t from the Premises when Lessee is in naterial de- <br />fault under this Lease unless so directed by CFSI. Upon Les- <br />see's request and for good cause shown, CFSI shall extend the <br />period for removal of the structures listed for such period of <br />time as is necessary for the Lessee to, in good faith and with <br />reasonable diligence, remove such structures. Lessee shall <br />remove all such property it erected or placed on the Premises <br />unless it notifies CFSI and obtains CFSI's consent to leave any <br />such property on the Premises. Any such nrooerty remaining on <br />the Premises with or without CFSI's consent and after the time <br />provided herein shall become the sole property of CF6I, and <br />Lessee shall be deemed to have conveyed its right, title, and <br />interest therein to CFSI; provided, however, that, to the ex- <br />tent such property is on the Premises without CFSI's consent, <br />Lessee shall remain obligated to remove such property from the <br />Premises at CF6I's direction and shall remain liable for any <br />expenses incurred by CFSI in disposing of such property. <br />X. DEFAULT <br />The failure of Lessee to ¢~ake or cause to be made any of <br />the payments herein provided for or to keep or perform any cov- <br />enant or agreement on its part to be kept or performzd accord- <br />ing to the terms or provisions of this Lease shall, at the <br />election of CFSI, constitute an event of default. Lessee shall <br />have a reasonable time, not more than 30 aays after receipt of <br />notice, to cure or commence to cure such default. Failure by <br />CFSI to terminate upon default by Lessee shall not be a waiver <br />of CFSI's right to terminate this Lease for future defaults of <br />Lessee of the same or a different type. In the event CFSI does <br />terminate this Lease as a result of a default by Lessee, Lessee <br />shall be under no further obligation or liability hereunder to <br />CFSI from and after the date of such termination, ..except for <br />the performance of obligations and the satisfaction of liabili- <br />ties to CFSI, including but r.ot limited to, payment of royal- <br />ties and compliance with reclamation laws and regulations, <br />respecting the Premises which have accrued prior to the date of <br />such termination. <br />XI. RECORDS, INSPECTION AND CGti~IDENTIALITY <br />11.1 Inspection. CFSI and its scents ma}~ enter upon the <br />Premises to inspect the same, during normal business hours and <br />at such times and upon such notice to Lessee as shall not un- <br />reasonably hinder or interrupt Lessee's operations and activi- <br />ties. Lessee will maintain and furnish to CFSI, annually, a <br />mine map and all records of drilling, assay reports, or other <br />factual data pertaining to operations on the Premises.
