• (b) The written notifications shall be sent to: <br />(i) Federal and Stale aeencies attd various local govenunental bodies <br />_with iurisdiction over or an interest in the area of [he proposed operations, including but no[ limited to [he U S <br />Department of Agriculture Soil Conservation Service District Office the local U S Armv Corps of Eneineers <br />District Engineer, the National Park Service, municipalities, boards of counh~ commissioners, State and Federal fish <br />and wildlife agencies and the historic preservation officer; <br />(ii) Regional planning commissions, county planning agencies or other <br />governmental planning agencies with iurisdiction to act with reeard to land use, air or water 4uality in the area of <br />the proposed operations; <br />(iii) Sewage and water treatment authorities, attd water conservancy and <br />water conservation districts, and water companies either orovidine sewaee or water services to users in the area of <br />the proposed operations, or having water sources or collection, treatment, or distribution facilities located iit these <br />areas; and the Federal or State government agencies with authority to issue all other permits and licenses needed by <br />the applicant in connection with operations proposed in the application. <br />c) These local bodies, agencies, or authorities may submit written comments <br />to the Division, within 30 days of the last publication of the above notice, with respect to the effect of the proposed <br />operation on the environment which is within [heir area of responsibility. Such comments shall be irnmedia[ely <br />transmitted to the applicant by the Division and shall be made available to the public at the same locations as the <br />ermit application <br />RESPONSE <br />A copy of the Proposed Notice for this permit revision application is provided in Exhibit 4, Newspaper <br />Advertisement. The advertisement was prepared in accordance with each of the requirements stipulated in Rule <br />2.07.3(2). Proof of Publication of the advertisement will be filed with the CMLRD not later than four (4) weeks <br />after the last date of publication. <br />4) (a) The applicant shall make a full copy of his or her complete application for a Hermit, except <br />for data and/or other information if it is determined by the Division to be con£dcn[ial accordine to 2.07.5. available <br />for the public to inspect and copy. This shall be done by filing a copy of the application submitted to the Division <br />with the recorder at the courthouse of the county where the mining is proposed to occur, or another ertuivalent <br />public office if it is determined that office will be more accessible to local residents than the county courthouse. <br />(b) The applicant shall file the copy of the complete application, less confidential matters, by the <br />first date of newspaper advertisement of the application. The applicant shall file any subsegaent revision of the <br />application with the public office a[ dte same [irne the revision is submitted to the Division. <br />~) Anv person having an interest which is or may be adversch- affected bs a decision of the <br />Division regarding the proposed surface coal mining operation, or the officer or head of any Federal, State. or local <br />government agency or authority, shall have the right to submit written obiections to or comments upon the initial or <br />revised application for a permit permit revision or permit renewal to the Division within 30 days afier the last <br />publication of the above notice.
