(6) Informal Conference. <br />(a) Within 30 days after the last publication of the notice specified in 2.07 3(2) <br />any person who tiles objections or comments pursuant to 2 07 3(3)(c) 2 07 3(5) or 3 03 2(3) may request nn <br />informal conference. The request shall: <br />(i) Bricfly summarize dte issues to he t~2ised by the requestor at the <br />conference: and <br />(ii) State whether the requestor desires to have the conference conducted <br />in the locality of the proposed minine operations. <br />(b) Except as provided in 2.07.3(6)(c), if an informal confcrencc is requested, <br />the Division shall hold the informal conference within 60 days after [he last publication of the newspaper <br />advertisement. The informal conference shall be conducted according [o the followine: <br />operation or release. <br />{i) I[ shall be held in the locality of the proposed surface coal minine <br />(ii) The date, time and location of the informal confcrencc shall he <br />advertised by the Division in a newspaper of eeneral circulation in the locality of the proposed mine al leas[ two <br />weeks prior to the scheduled conference. <br />(iii) The Division may arrange with the applicant, upon written request by <br />any person who has submitted obiections, comments or a request for an informal conference, access to the proposed <br />permit area for the purpose of gathering information relevant to the conference. The inspection shall be conducted at <br />least 10 daVS pnor to the informal conference and shall be subject to the condition that the visitor shall at all times be <br />accompanied by the applicant, his aeent or employee, he under their control, direction and supervision and aeree in <br />writint; to comply with all applicable State and Federal safety rules and regulations. A[ no time shall [he applicant, <br />his agent or employee. use this control to restrict the visitor's access to those portions of the proposed mine plan area <br />necessary for the eatherino of information relevant to the conference. 'Fhe Division shall be in attendance if so <br />requested. <br />(iv) The requirements of the State Administrative Procedures shall not <br />apply to the conduct of the informal conference. A representative of the Division, who may accent oral or written <br />statements and amp other relevant infomtation from any party [o [he conference, shall conduct the conference. An <br />electronic or stenographic record shall be made of the conference proceedine, unless waived by all the parties. The <br />record shall be maintained and shall be accessible to the parties of the conference until final release of the <br />ermittee's bond under Rule 3 <br />(c) If all panics requestin¢ the informal confcrencc stipulate a~~reemcnt before <br />the requested informal conference and withdraw their request, the informal conference need not he held. <br />(d) Informal conferences held in accordance with 2.07.3 may be used by the <br />Board as the public hearine required tinder 2.07.6(2)(d)(iv) on proposed uses or relocation of public roads. <br />2.07.4 Division and Board Procedures fnr Review of Permit Applications. <br />(I) Within 60 days of the liline of an application for a permit, permit revision or <br />permit renewal, but no sooner than 30 days after such tilint*, the Division shall review said application and notify <br />the applicant of preliminary findins as to the substantive adequacy or inadequacy of the application. <br />Permit Renewal No.3 2.07-4 3/5/99 <br />
