<br />Mr. Gregg Squire <br />Division of Minerals and Geology <br />August 3, 1995 <br />Page 2 <br /> <br />The applicant is in the process of permitting this operation with Lazimer County. ~n,oG 1 <br />Connell has committed to the minimum setbacks required by the County. <br />We have located the two irrigation ditches on Exhibit C. The irrigation ditch that <br />starts on the north end and wraps around the east and south sides of the property <br />will not be removed. The other irrigation ditch feeds crops on the central portion <br />and west side of the property. This azea will be mined by Connell. The lease <br />agreement allows Connell to mine areas of the property including the land <br />containing the irtiga[ion ditch on the west. The forthcoming statement from <br />Grant includes a statement about having no objection to the removal of this ditch. <br />Connell is in the process of working out an agreement with the Box Elder Ditch '~ <br />Company to allow the construction of an access road across the Arthur Lateral <br />Ditch and mining within 200 feet of this ditch. <br />B. The processing equipment is portable and will be continually moved around <br />throughout the life of the operation. Connell expects to locate the processing <br />equipment both in and out of the pit. For example, during Phase One Connell will <br />first place the processing equipment on an azea of Phase One that will not be <br />mined immediately. When it comes time to mine the area of Phase One where the <br />processing equipment is located, Connell will move the equipment into the pit. <br />Connell expects to move the asphalt batch plant from the Stute Pit to the <br />Wellington Downs Pit three years from the start-up date. This will allow Connell <br />time [o backfill and stabilize a portion of ground for the asphalt batch plant. The <br />placement of the asphalt batch plant will be permanent. <br />,, 1~~ <br />Connell will preform "Best Management Practices" to prevent the contamination ~,VZ ~ <br />of ground and surface water. In addition, they will abide by regulations set by the ~''"~ <br />Colorado Department of Health and Larimer County Health Departments. They Std <br />have put together a Storm Water Management Plan as pari of the requirement of <br />the State's Storm Water and Process Water Discharge Permit. The plan address <br />"Best Management Practices" and spill prevention techniques. All fuel tanks will <br />have earthen berms around them and the tanks will be raised above the floodwater <br />elevation. <br />
