<br /> <br />Y <br />TUTTLE APPLEGATE RINDAHL, INC. <br />Consultants for Land and Resource Development <br />Mr. Michael Boyd <br />Mined Land Reclamation Division <br />August 16, 1989 <br />Page 4 <br />It is our intention that the road act as a low water <br />crossing and be stabilized with riprap erosion protection to ~~ <br />prevent damage to the roadway structure in the case of <br />frequent overtopping. We are hesitant to increase the size <br />and/or height of the culverts and the crossing due to the <br />additional approach grading and increased fill in the <br />channel. <br />Please find enclosed correspondence with Terry McKee of the <br />Army Corps of Engineers regarding inclusion of this crossing <br />within a nationwide 404 permit based upon the previously <br />indicated culvert sizing and fill amount. In order to <br />minimize potential fill and riparian impacts, we maintain <br />that the smaller crossing should be constructed initially. <br />If the proposed crossing proves impassable too frequently or ~ <br />sustains damage, Hallett Materials is amenable to then a~ <br />reconstructing the crossing to convey greater flows at a <br />future date. <br />2. Wells - One well permit application has been submitted to <br />the Colorado Division of Water Resources. The well is to be e~~/ <br />non-tributary (Lower Dawson) ground water and no <br />augmentation is required. Anticipated consumptive use for <br />the operation is approximately four acre-feet of raw water <br />annually. This includes all plant operation requirements. <br />Reclamation Costs (Exhibit L <br />1. As mentioned earlier, we will sell excess overburden as non- <br />classified fill and also as clay for brick manufacture. In <br />the event these sales do not occur and the bond is <br />forfeited, we may have as much as one years supply of total <br />overburden amount. As stated in our report, the average <br />depth of overburden is six feet over the property. During <br />the mining operation itself, the stripings for the next <br />years mining will be removed and placed as overburden and <br />topsoil on the previous years mining. During the mining <br />operation itself, we will have very little topsoil and <br />overburden stockpiling as indicated in our total of four <br />acres of stockpiles in the Table of Disturbance on Page D-5. <br />
