Page 2
~~3. You have described the possible use of a conveyor or low water crossing to transport gravel to
processing azeas in a permitted area south of this proposed operation or south of the Cache La
Poudre River. If these transport routes are not on public transportation routes or entirely on
permitted lands, the unpermitted portion of the route should be added to this or another
permitted area and all appropriate sections of Rules 6 and 3 should be addressed. If the
material is ultimately stockpiled at a permanent sales lot or plant area, that area may not have to
be permitted.
~`ti 4. Your plan says water may be diverted from the Callahan drain, you must decide whether you
are or are not going to divert water From the drain ditch. If you are, this diversion, unless it
already exists must be added to your permitted azea and addressed in accordance with the
requirements of Rule 6 and 3.
pit 5. Rule 6.4.4(f((i)(ii) requires that the application present information regarding the nature, depth,
and thickness of the deposit to be mined and the thickness and type of the overburden to be
removed. Please provide this information. It may be marked "Confidential if you so desire.
Also, provide the nature of the stratum immediately beneath the material to be [Wined.
Exhibit E-Reclamation Plan
p~t,1. Your plan is to create three ponds. Your mining plan map does not show that you plan to leave
in place the embankments between the ponds. In fact, the Exhibit C map indicates the road on
the reclamation embankment between the north and south ponds will be removed. Please
explain- Will the embankments be removed during mining and replaced during reclamation or
will [Wining occur in such a manner that the embankments will be left in place?
~~ti2. During the pre-operation inspection, the Division was told that the farm access road across the
pit azea will be relocated to a location north of the pit. Your plan seems to indicate that the
road will be reestablished in it's present location after mining is complete. Please clarify this
issue.
~3. Your plan under-Tree Buffer Plantings-indicates [hat revegetated overburden stockpiles will be
left in place upon final reclamation. The reclamation plan map does not show contours
indicating that piles of overburden will remain in that azea. Please clazify this issue. If
overburden stockpiles aze to remain, please discuss this in relation to your overburden plans.
Also, show the piles on the reclamation plan map.
Exhibit G-Water Information
t 1. Please address any potential impact that dewatering of the pits will have on the quantity of
`like Sr pt water flowing in the Taylor-Gill irrigation water supply ditch, in-other-words impacts on water
~,~¢6 ~'1~ rights of individuals east of Taft Hill Road.
~) Your operation will affect groundwater. Please address the requirements of Rule 6.4.7(2)(c).
u~`
a~ 3. Your mining plan stated that you may divert water from the Callahan Drain Ditch as a water
source. What is your water right to make such a diversion, and why should it be necessazy,
since the pit azea contains groundwater.
