<br />Mr. John Jordan <br />Tuttle Applegate, Inc. <br />4. <br />Water Information <br />A. Addressed under Item 2.A. <br />B. Resolved. <br />-3- <br />August 15, 1995 <br />C. The applicant states, "The upgrading of the.existing culvert under County Road #36 is not <br />expected to be necessary." What is the size of the current culvert? It appeazs that this <br />culvert will carry irrigation flows, water from the dewatering of the current pit to the <br />north (Western Mobile), and water from the dewatering of the Wellington Downs Pit, as <br />well as some stormwater runoff. Please provide a water balance (total maximum expected <br />flow through the culvert) and a demonstration that the culvert can carry the maximum <br />expected flow. <br />D. Without the "forthcoming statement from Alexander Grant" committing to use his shares <br />of Box Elder ditch water to fill the reservoir, the Division must increase the calculated <br />reclamation bond to provide water to fill the reservoir. <br />As part of the adequacy review, the Division stated: <br />On page 11 of the application, it is stated, "The Lessor shall be responsible [for <br />theJ operation of the reservoir and jor any leasing of water storage rights. " The <br />Division must receive some documentation that the lined storage reservoir wilt <br />actually be used for the proposed post-mine use. Please provide documentation that <br />the landowner has sufficient water rights available to f:J! the reservoir and that the <br />water can be used for this purpose. Has approval been received from the Stale <br />Engineer's oj~ce for this use? If so, please submit documentation that demonstrates <br />this. If not, please provide evidence that such approval has been applied for. <br />The applicant has not provided the requested documentation that: (1) the landowner has <br />sufficient water rights available to fill the reservoir; (2) the water can be used for this <br />purpose; (3) that approval has been received from the SEO for this use; and (4) SEO <br />approval has been received or applied for. - <br />As an additional comment, enclosed is a memo from the SEO, received July 21, 1995, <br />listing the need for a gravel well permit, approved water supply plan, or a decreed plan <br />for augmentation. It also indicates that the applicant will need a waiver of objection from <br />well owners within 600 feet or request a hearing before the State Engineer, and asks for <br />evidence that the proposed project will not alter or impact the historic operation of the <br />existing water rights. Have these items been resolved? <br />5 <br />Reclamation Costs <br />This item has been adequately addressed with the exception that additional bond may be <br />required for the removal of stormwater management structures and the filling of the reservoir <br />
