Also, the applicant states in Exhibit D, Mining Plan, Phasing, "These phases aze <br />neither representative of the maximum area of disturbance nor do they limit disturbance to a <br />particular phase." It does not appeaz that the applicant has committed to the phasing or to a <br />maximum amount of disturbance. If this is the case, the Division must bond for a maximum <br />disturbance of the entire pit. <br />Will the applicant commit to installing the liner in the phased order as described in the <br />application, or is this operation also not limited to a particular phase for the liner installation? <br />If there is not a commitment to phasing the liner installation, the bond will also need to be <br />increased for a complete liner installation including pumping out the pit to install it. <br />If the water issues with the SEO are not resolved, concerning the filling of the reservoir with <br />SEO-approved water, the Mined Land Reclamation Board has directed the Division to bond for <br />backfilling the pit to two feet above the groundwater table. <br />If you wish to have this permit approved on the decision date of August 17, 1995, the Division <br />must requite a bond to backfill the pit based on a cost of $IS/yd' of imported material plus <br />topsoiling and seeding. Numerous stipulations would also be required concerning liner <br />compaction, culvert designs, requirements to stay 200 feet from all permanent man-made <br />structures, approvals from the SEO or a change in the reclamation plans, and possibly other <br />stipulations.
