<br />(3) All proposed grading will be done to minimize and control erosion and sedimentation <br />of the affected land and prevent off-site discharge of sediment. There are no proposed <br />highwalls that will be left from the mining operation. <br />(4) All backfilling and grading will be done in a reasonable timetable as soon as mining <br />operations allow reclamation to proceed. <br />(5) There are no known acid producing or toxic materials on the property as a result of <br />the mining operation and any materials of this nature that might be found will not be <br />used in the reclamation plan. if materials of this nature are found on the property, <br />they will be disposed of according to applicable laws. <br />(ti) There are no drill or auger holes associated with the mining operation. There are no <br />known mining shafts or adits in existence in this area from past metal mining <br />operations. if a shaft or adit is uncovered during the mining operation, it will be <br />closed and sealed in accordance with good engineering practice. <br />(7) The proposed slopes for the reclamation plan are compatible with the surrounding azea <br />and in most cases are milder than those wmmonly found in this steep mountainous <br />terrain. <br />3.1.6 Water <br />(1) All disturbance in the area is planned to minimize disturbance to the hydrologic <br />balance as follows: <br />(a) The Operator agrees to comply with all applicable Colorado Water law and <br />regulations governing injury to existing water rights. <br />(b) The Operator agrees to comply with all applicable Federal and State water <br />quality laws and regulations . <br />(c) The Operator agrees to comply with all applicable Federal and State laws with <br />regard to dredge and fill requirements. <br />(d) The Operator agrees to remove any erosion control or sedimentation structures <br />that are temporary in nature and not a part of the reclamation plan. <br />3.1.8 Wildlife <br />The proposed reclamation plan does not propose to create wildlife habitat. There are no <br />known endangered species that are dependent on this property and all mining activities are <br />based on considering the safety of the area wildlife. It is anticipated that the mining will <br />temporarily displace some wildlife species. These species should have no difficulty in <br />reestablishing themselves once the mining and reclamation is completed. <br />E-2 <br />
