If necessary, Sunbelt will replace the water supply of any owner of
interest in real estate who obtains all or part of a supply of water for
domestic, agricultural, industrial, or other legitimate use from an
underground or surface source where the water supply has been adversely
affected by the mining operation.
4.05.16 Discharge Water into an Underground Mine
No surface water will be diverted or otherwise discharged into any
underground mine workings.
4.05.17 Post-Mining Rehabilitation of Sedimentation Ponds, Diversions,
Impoundments, and Treatment Facilities
No permanent sedimentation ponds, diversion ditches, impoundments, or
treatment facilities are planned; therefore, the requirements of this
Section do not apply to this application.
• 4.05.18 Stream Buffer Zones
Because of the compact nature of the facility location for the Peacock
Coal Mine, it is necessary to encroach within the 100 foot zone of Hay
Gulch. Although location of the sedimentation pond will be necessary
within 100 feet of Nay Gulch, the original stream channel will not be
moved by Sunbelt. Furthermore, as shown on the Drainage and Sediment
Control Plan Map (Map 6), special care has been taken to design
diversion ditches and sedimentation ponds to prevent any water quantity
or quality change from the surface activities of the underground
operation. Likewise, special care has been taken to provide for the
reestablishment of appropriate vegetation, both during and after mining.
Therefore, no adverse impacts on Hay Gulch will be expected from
locating the sedimentation pond of the Peacock Coal Mine within 100 feet
of Hay Gulch.
•
4.05-9
