Enginc•er•ti will consult with Lire U.S. Fish and Wildlife Service on <br />specific requests to perform work under this RGP when a project <br />may affect. a_Lhreatened or endangered species. <br />• 6. Only clean material free of waste metal products, bituminous <br />asphalt, organic materials, unsightly debris, etc., may be used <br />for discharges authorized under this RGP. <br />7. All .instream work should be performed during low water <br />periods and use of heavy equipment in streambeds, especially in <br />]ive or flowing water, should be minimized. <br />8. Approval to perform work under this RGP does not obviate or <br />mnke unnecessary the rc•yuirements of other Federal, state or <br />local permit.t.irtig authorities. For example, ttre Bureau of Land <br />Mxuagement. should be cont.act.ed regarding work on public lands <br />and similarly, approval from your local County government may <br />be required in accordance with local zoning or floodplain <br />regulations. <br />9. This permit does not. grant any property rights or exclusive <br />privileges, does not authorize any injury to property or rights <br />of others, and does not authorize interference with any existing <br />or proposed Federal project. <br />]0. Any discharges of dredged or fill material shall not occur <br />in close proximity of a public water supply intake, should not <br />limit the ability of any existing diversion structure to <br />• appropriate water and should not adversely impact a stream gaging <br />station. <br />11. You mint maintain the ac:t.ivity authorized by this permit in <br />good condil.ion anri irr conformance with the terms and conditions <br />of this permit. You are• not. relieved of this reyuirement if you <br />al,ancion the l,ermit.teci ac:t.ivity, although you may make a good <br />f:rit.h t.ransl'er to a t.lrir,t l,arty. Should you wish to cease to <br />maintain t. tie authorized activity or should you desire to abandon <br />it, wit. Front a good faith transfer, you must obtain a modification <br />of your approval from the Corps of Engineers, which may require <br />restoration of the area. <br />1~. The permittee shall abide by the terms and conditions of the <br />water yuality certification issued by the Colorado Department of <br />Health or• the Environmental Protection Agency in accordance with <br />Section 401 of the Clean Water Act. <br />]3. Activities occurring in a component of the National Wild and <br />Scenic: River System or in a river officially designated by <br />Congress as a "study river" for possible inclusion in the system <br />while the river is in arr official study status, will not be <br />authorized by this permit.. <br />• <br />R <br />
