Ac•tivit.ies aul.hor•ized by t.hiti permit, may ant. adversely <br />affect. hisloric properties MlI1Ci1 Lhe National Park Service has <br />listed, or• determined eligible 1'or ]isl.ing, on Lhe National <br />• Register of Historic Places. 7f the Corps of Engineers <br />determines that such historic properties may be adversely <br />affected, the District Engineer will proceed in accordance with <br />regulations implementing the National Historic Preservation Act <br />before deciding if the activity may be approved under this <br />permit. <br />15. If you, before or during prosecution of the authorized work, <br />encounter a historic property that has not been listed or <br />determined eligible for listing on the National Register, but <br />which may be eligible for listing in the National Register, you <br />shall immediately notify the Corps of Engineers. <br />16. Tn issuing 1.his permit and in giving authorization to <br />pPrfor•nl work under this T>ermit., the Federal Gov e.rnment does not <br />assume any liahility for damages to the permitted project or uses <br />thereof as a result, of current or future activities undertaken by <br />or nn behalf of the United States in the public interest, damages <br />I.o persons, proper•t.y, or t.o other permitted or unpermitted <br />activities or structures caused by the activity authorized by <br />this permit, design or construction deficiencies associated with <br />the permitted work, or damage claims associated with any future <br />modification, suspension, or revocation of this permit. <br />• 17. You must allow representatives Prom the Corps of Engineers <br />to inspect the authorized activity at any time deemed necessary <br />to ensure that it is being or has been accomplished in accordance <br />with the terms and conditions of this permit. <br />18. The construction or operation of the activity authorized by <br />this permit will not impair reserved tribal rights, including, <br />but not limited to, reserved water rights and treaty Yishing and <br />hunl.ing rights. <br />19. The Corps of Engineers may re-evaluate its decision on any <br />authorization given in accordance with this permit at any time <br />circumstances warrant. Circumstances that could require a re- <br />evaluation include, but are not limited to, the following: <br />a. You fail to comply with the terms and conditions of this <br />permit; <br />b. The information provided by you in support of your <br />application proves to have been false, incomplete, or inaccurate <br />and; <br />c. Significant new information surfaces which the Corps of <br />Engineers did not consider in reaching a decision. <br /> <br />9 <br />
