The Board or Division may reasonably request additional <br />information to evaluate the proposed revision. <br />RESPONSE <br />TCC, by submission of this complete permit revision application, request revision of its presently approved Permit <br />No. C-82-056. This complete permit revision application addresses the planned mining and reclamation activities <br />associated with expanding the presently approved Foidel Creek Mine pilot project to a full life-of--mine <br />underground mining venture. Any and all changes in the mining and reclamation operations previously approved <br />under Permit No. C-82-056, which may have an effect on performance bond requirements of Rule 3, have been <br />specifically addressed within the responses to Rule 3. <br />TCC will supply DMG with any reasonably requested additional information which may be necessary for DMG to <br />determine that this application complies with the Act and Regulations of the Division of Minerals & Geology. <br />(6) Hearing and notice requirements. <br />(a) Permit revision. An application for a permit revision shall be subject to the hearing and <br />notice requirements of 2.07. <br />bl (i) Technical revision. An aonlicant for a technical revision shall place an <br />advertisement in a local newspaper pursuant to the requirements of 2.07.3(2), except that the publication need only <br />be once and no reference to an informal conference need be made. The applicant shall make a copy of ttis or her <br />complete application for the public to inspect and copy. This shall be done by filing a copy of the application with <br />• the recorder at the courthouse of the county closest to the operations or if approved by the Division, at another <br />equivalent public office, if it is determined that the office will be more accessible to local residents than the county <br />courthouse. The public copy shall be tiled at the same time as the advertisement. <br />Anv person bovine an interest which is or may be adverseh~ affected by a decision of <br />the Division re¢arding the proposed technical revision, or the officer or head of any Federal, State, or local <br />government agency or authority, shall have the right [o submit written obiections to or comments upon the initial or <br />revised application for a technical revision, to [he Division +vithin 10 days after the publication of [he above notice. <br />Such obiections attd comments shall immediately be transmitted to the applicant by the Division and shall be made <br />available to the public, at the same locations as the application. <br />(iii) Within 60 days after the feline of a complete application for a technical revision, <br />the Division shall issue a proposed decision approvine or denying the application in whole or in part. A written <br />copy of such decision shall be promptly provided to the permittee and shall be published once in a ne+vspaner of <br />general circulation in the locality of the surface coal mining operation. The applicant or any person with an <br />interest, which is or may be adversely affected may request a hearing by the Board. The request for a hcarin<: must <br />be received in writing by the Division within 10 days after such publication and shall contain a brief and plain <br />statement of facts which indicate the requester may be adversely affected, and briefly summarize the issues to be <br />raised by the requester at the hearing. [f properly requested under the provisions of this subsection, a hearing shall <br />be held at the next regularh~ scheduled Board meeting and a final decision shall be made at that hearing and become <br />immediately effective with notice of the decision being mailed to the pennittee.
