RESPONSE <br />TCC will comply with the applicable hearing and notice requirements of Rule 2.07 as a part of this complete permit <br />revision application. <br />(c) Minor revision <br />(i) Immediately upon receipt of a complete application for a minor revision, the <br />Division shall post a notice of the application in. the office of the Division and make a copy of the application <br />available for the public to inspect and copy at a reasonable cost. <br />(ii) Within 10 days after the filing of a complete application fa a minor revision, the <br />Division shall issue a decision approving or denying the application in whole or in part. A written copy of the <br />decision shall be promptly provided to the permittee and shall be posted in dte Division Office. <br />(iii) Within 10 days after [he notification required by 2.08.4(5)(c)(ii) above. any person <br />which has an interest which is or may be adversely affected may request a formal hearing on the decision by the <br />Division. Such request shall be in writing and state with reasonable speciticity the reasons for the request and <br />objections to the Division. If so requested, the formal hearing shall be conducted in accordance with the <br />requirements of 2.07.4(3). <br />RESPONSE <br />TCC is submitting this material as a complete permit revision application; therefore, Section 2.08.4(5)(c) is not <br />applicable to this application. <br />2.08.5 Rieht of Successive Renewal. <br />~) (a) Anv valid, existing permit issued pursuant to this regulatory program shall <br />catrt~ with it the right of successive renewal upon expiration of the temt of the penni~ in accordance with the provi- <br />sions of 2.03.5. Anv permit renewal shall be far an additional term not to exceed the period of the original permit. <br />(b) Permit renewal shall not be available for conducting surface coal mining <br />and reclamation operations on lands beyond [he boundaries of the pemtit area approved under the existing permit. <br />(c) If a complete application for renewal of a permit includes a proposal to <br />extend the mining and reclamation oueration beyond the boundaries authorized in the existing permit, [he portion of <br />the complete application for renewal of a valid permit which addresses any new land areas shall he subject to the <br />full standards applicable to the new• uennit applications under the Act and these Rules. <br />Ld) [f the surface coal mining and reclamation operations authorized under the original <br />permit were not subject to the standards contained in 34-33-I 14(3)(e)('f)IA) and I f3) of the Act and 2A6.3, because <br />the permittce compiled with the exception provided in 34-33-I l4(3)(c)(II) of [he Act (for surface coal mining <br />operations located within or adjacent to alluvial valley floors a»d producing coal in commercial quantities in the <br />year proceeding August 3, 1977, or operations that had obtained permit approval to mine within said alluvial valley <br />floors). the portion of the application for renewal of the permit which addresses any new land areas previously <br />identified in the reclamation plan submitted for the original permit shall not be subject to the standards contained in <br />34-33-I 14(2)(e)(I)(A) and (l3) of the Act and 3.06.3. <br />('-) Applications for permit rcne+vals. <br />Permit Renewal No.3 2.08-4 4/l/99 <br />
