-44-
• MR. N. COHEN: Before you start, may I as you a procedural question,
sir? I think I maybe lost track of what the procedure that we were going to
follow. My understanding of the meeting we had earlier, Frank, was that -- I
am assuming that what is happening now is that Mr. Massey is into his rebuttal
phase or the cross-examination of the hearing. If I'm wrong about that I
guess I ask for some clarification.
MR. JOHNSON: No, I think that is right. The Company to begin their
presentations, we allowed some additional presentation today on the part of
the Committee For Environmental Soundness. It is my understanding that you
are now in the rebuttal cross-examination phase.
MR. MASSEY: No question about it.
MR. JOHNSON: Is it your understanding then, Mr. Cohen, that he's -- going
to be presenting some direct testimony now --.
• MR. N. COHEN: Well, he's used the word presentation, I guess I'm
wondering if the presentation is going to be limited to the issues that have
been presented by other parties. If it's going to be in essence a
cross-examinatin or rebuttal of the direct evidence that's already been
submitted, then that's fine. That's what I would anticipate. If it's
something other than that, then I guess I'm confused and I just want to know
if that's what is intended or not?
MR. MASSEY: There's never -- no reason for confusion. We, as the Board
will recall, we started a rebuttal at the last Board meeting. Tanis is going
to be continuation of that rebuttal. In addition, it's going to provide
rebuttal to the presentation that the opposition made prior to the break.
MR. N. COHEN: That's fine, then I'm clarified, thank you.
•
