we can leave that as a matter of record and make those individuals available
for your questions, if that's appropriate. And that's purely at the Board's
choosing. If you want to deal with that later, we can do it that way.
MR. HOLDER: If you are going to answer the points they have already
brought up.
MR. MASSEY: We are going to answer the points they have brought up.
MR. HOLDER: Does that replace your rebuttal?
MR. MASSEY: Lastly, well -- I'm trying to wrap all of this in, kind of
feel like someone that is getting shot from a number of different sides here.
Lastly, we received the brief approximately ten seconds before you did.
• Nevertheless, we are going to give a shot at going through. We believe all of
the issues set forth in the opposition's memorandum are dealt with in the
application. I'm going to present testimony that indicates where and how
those issues are dealt with. Obviously, we disagree with the conclusion.
Also during the course of my presentation, I am going to be -- reserve the
right to ask questions or pose issues for the Mined Land Reclamation Staff. A
fair amount of the foregoing presentation raises into question conclusions
which they have made which we, in fact, concur with. It seems efficient to
get that all on the record during this presentation.
So with that minor introduction, all of the experts that are going to be
testifying for Battle Mountain today, have been qualified as experts in the
previous hearing. Their resumes and qualifications were submitted and made a
record prior to that porceeding. I may ask the individuals to reiterate their
experience just to update the Board. I believe all of them have also been
sworn in, so we will just proceed from there.
