• -41- <br />Chairman of this State Emergency Response Committee, he said that I had done <br />what I was required to do through the Committee. And when they appointed me <br />as Chairman I took the responsibility even if I enjoy my work as emergency <br />medical technician instead of all this other involvement. But that's why I <br />think I was guided by ~ supervisor to send it then, get copies, he said get <br />certified copies, and this is what I was told. <br />MR. BARRY: I hear you. I'm just -- it's not clear to me that they are <br />out of compliance with either State or a Federal law at this point. I think <br />they've got -- they will have -- at the point they have the permit -- and then <br />they will have hazardous or toxic materials on site. I think they have to <br />comply. I'm not sure what that means right now. <br />MR. ORTEGA: Maybe EPA and SARA Title III experts could clarify this for <br />the Board before the permit would be granted or whatever. <br />• MR. HOLDER: Chips, to clarify one point, I think we asked them to <br />prepare an emergency plan for what they themselves would do on-site in the <br />event of an emergency. And they have done that. And I think just at a <br />cursory examination they've done an excellent job of it. We haven't had time <br />to study it yet. The Staff says it's good. I think this man is right to be <br />concerned about what would the citizens of San Luis do in case there is an <br />emergency. I think it would behoove the Company to get with them at the <br />earliest possible date and work out emergency planning. It's not this Board's <br />jurisdiction. They have complied with the part of it over which we do have <br />jurisdiction. But, I certainly would lend my support to you in getting with <br />the Company and getting a plan organized and worked out. You are entitled to <br />that. <br />MR. BARRY: And, Davis, for what it's worth, I agree with you about <br />that. My point would only be if I were the Company, till I had a permit, I <br />might rat respond to all this stuff and when I did, I certainly ~i>ught to <br />respond quickly and firmly and effectively. <br /> <br />
