iiiiiiiiiiiuiiiiii
~~_
-40-

State Commission, be met. Because at this point, it's an inadequate emergency
response plan and I'd like to answer any questions if the Board has any?
MR. HOLDER: Does anybody have any questions?
MR. BARRY: Yeah, I do. Prax, do you -- you don't go out buy a whole
new set of baby clothes before you know your wife is pregnant, do you?
MR. ORTEGA: I might. There's different thoughts.
MR. HOLDER: He's a planner.

MR. BARRY: I ask the question that way because I knew you might give me
a good answer. My point, though, is I don't know anything about SARA Title
III. It seems to me that these guys aren't present in your county with an
operation there. [mean, they
didn't have something to say about this, I don't have any idea what they are
saying. But, yeah, ihey've got the 120,000 pounds of cyanide on site, that
would seem to me that they would probably come under some sort of SARA
Emergency Response and at that point, I think they got to comply, I don't
know if they have to comply now. Because they don't have anything yet.
MR. ORTEGA: I could answer that. See, because I'm just they low man on
the totem pole anyway. So I went to my Division Supervisor, Mr. Jack Truby
and I said, "Jack, what shall I do?" He says, "Well, maybe E1 Paso County has
a sample why we invent the wheel and this new SARA Title III regulations; send
it to the mine people now." And I did that solely on the advice of my
supervisor, and in my meeting this morning with Mr. Pat Burn who is the
