(a) To the extent appliceble, and except as set forth herein, § 25-12-103, C.R.S. <br />(Maximum Permissible Noise Levels), shall be and hereby is <br />incorporated herein as set forth in its entirety. This development shall be <br />conducted in a manner so that any noise produced is not objectionable <br />due to intermittence, beat frequency or shrillness. The commercial <br />classification of the statutory noise standards is most appropriate for this <br />area, the sourxi levels of noise radiating from the property line, <br />attributhble to AppGcartt's mining andfor crushing operations, wherein the <br />development is located at a distance of twenty-five (25) feet or more <br />therefrom in excess of the db(A) set forth below for the following time <br />periods shall constitute prima facie evidence chat such noise is a public <br />nuisance. <br />(1) 7:00 a.m. to the next 7:00 p.m., Monday through Friday: 60 db(A) <br />(2) 7:00 p.m. to the next 7:00 a.m., Monday through Friday and at all <br />times on weekends: 55 db(A) <br />(3) In the hours between 7:00 a.m. and the Went 7:00 p.m., the noise <br />levels pemtitted herein may be increased by ten (10) db(A) for a <br />period not to exceed fifteen (15) minutes in any one-hour period. <br />(b) At any point 200 feet beyond the Applicant's property line, the noise level <br />shall not exceed 55 db as provided for in Colorado Revised Statutes for <br />Residential Areas. (See § 25-12-103, C.R.S.) In the hours between 7:00 <br />a.m. and the next 7:00 p.m., the noise levels permitted herein may be <br />increased by ten (10) db(A) for a period not to exceed fifteen minutes in <br />any one-hour period. if this standard cannot be met, then the <br />development will not be authorized to proceed. <br />11. Noise reduang measures may inlude the following: <br />(a) If a generator is used to provide power to the crusher, ft may be housed <br />in an insulated modular or nrobile structure, may incorporate the use of a <br />residential or a large industrial muffler, for purposes of sound mitigation, <br />and maybe paced in such a directlon to minimize noise emanating from <br />the gravel operation site. <br />(b) All other equipment powered by internal combustion engines operating <br />on the site maybe equipped with functional industrial mufners. <br />(c) Applicant may use existing barriers, may construct a berm along the full <br />length of the western property line at a height of eight (8) feet and provide <br />adequate vegetation to minimize erosion of the berm, and may create <br />and maintain stockpiles to the extent necessary to prelude to the <br />greatest extent possible the movement of sound towards residences in <br />the area. <br />(d) Rubberized material may be used to line dump points on the crusher. <br />12. If and when distance-activvated backup alarms are used on County equipment in Delta <br />County gravel pits, such alarms shall be installed on applicable equipment used in this <br />mining operation. <br />
