12. Issue 7(C): Protection of Off-site Lauds From Slides or Damage (Including <br />Flooding) During Mining and Reclamation (Section 34-32.5-116(4)(j)). Section 34- <br />32.5-116(4)(j) of the Act requires an applicant to protect areas outside of the affected <br />lands from slides or damage (including flooding) occurring during the mining operation <br />and reclamation. Based on the Division's review of the application and as stated in the <br />Rationale, the Applicant will not significantly increase any drainage basins that could <br />lead to increased flooding due to increased water collection and flow. The mining plan <br />calls for a maximum of six acres of disturbed land at any one time, which will minimize <br />the potential for off-site flow or flooding. Even though Delta County authorized the <br />•°Applicant to lower the ridgeline by 50 feet, the proposed operation'is not expected to <br />ircrease water flow offthe south face ofthe affected ridge because~materials must be <br />pulled down and to the north, away from the ridge face. The Division concluded that <br />areas, outside of the affected lands are not subject to damage from erosion of the south <br />ridge caused by the operation. <br />13. The weight of the evidence demonstrates that the Applicant has met the minimum <br />requirements of Section 34-32.5-116(4)(1) of the Act. <br />14. Issue 7(D): Adequacy of Geotechnical Analysis of Off-Site Impacts to the Cliff Face <br />and Underlying Workings (Rule 6.5). Rule 6.5 requires the applicant to provide a <br />geotechnical evaluation of all geologic hazards within the vicinity of the affected lands <br />when applicable. In response to this requirement, the Applicant submitted a geotechnical <br />stability report prepared by Revey & Associates, Inc. (the "Revey Report"). As stated in <br />the Rationale, the Division reviewed the Revey Report, comments from citizens and <br />follow-up information provided by Revey & Associates, Inc.
