County has not zoned this property. There is no adopted local land use plan with which <br />to compaze the proposed post-mining land use. In contrast to the claims made by project <br />objectors, the project maps submitted by the Applicant accurately depict all structures <br />within 200 feet of the proposed affected lands, as required by Rules 6.4.3(b) and (g). The <br />maps provide current information regazding adjacent landowners. <br />9. The weight of the evidence demonstrates that the Applicant has met the minimum <br />requirements of Rules 1.4.1(3), 6.45(2)(b), 6.4.3(b) and 6.4.3(g). <br />10. Issue 7(B): Accuracy of Projected Amounts of Water and Water Sources Necessary <br />to Supply Project Water Requirements (Rule 6.4.7(4)). Rule 6.4.7(4) requires an <br />~-~ •`applicant to indicate the projected amount from each water source necessary to supply the <br />" -project's water requirements. The Applicant has stated in the application that water to be <br />used for the proposed operation will be trucked in from the Applicant's industrial ditch in <br />Austin, Colorado. The Applicant owns water rights for that use. If the Applicant chooses <br />to provide water from another source, the Applicant has committed to submitting a permit <br />revision either by means of a technical revision or a permit amendment depending on the <br />scope of the revision. The Division will determine whether a technical revision or a <br />permit amendment will be required. The Applicant must also obtain approval from the <br />Office of the State Engineer for any other new water source if it proposes to use other <br />water. If a new source is permitted by the Office of the State Engineer, the Applicant's <br />water usage will be limited by the terms of that new permit. <br />11.
