i • <br />M-97-071 <br />Page 8 <br />approximately 3200 feet along with pit floor regrading. <br />Once the mining and reclamation plans are clearly defined with respect to what activities will be <br />occurring within each phase or stage, the Division will revisit the reclamation cost estimate to <br />determine the final financial warranty amount. <br />6.4.13 EXHIBIT M- Other Permits and Licenses <br />The issuance of a Reclamation Permit does not relieve the applicant of their responsibility for <br />obtaining or maintaining other required permits as necessary to conduct mining operations. <br />Attached to this letter aze any comments that our office has received from other commenting <br />agencies that we normally contact to review the proposed activity, however, it is the operator's <br />responsibility to obtain clearance from those agencies listed under this exhibit. <br />The application states that a 404 permit is not required because wetlands are not present or will <br />not be disturbed, however, there are small wetlands present in the bottom of the Peck Creek <br />tributary. Based on the review of the application it does not sound like these potential wetlands <br />would be disturbed, however, the mining plan map and reclamation plan map both indicate that <br />mining, including potential slab mining, will occur in this azea. Perhaps the types of mining that <br />is planned for the vazious azeas could be clarified both on the maps and in the narrative so that <br />the Division would be better able to predict the potential impacts and reclamation requirements. <br />Siloam Stone has indicated that no NPDES permit will be required, however, based on the <br />proposed plan, the Division believes that some stotm water runoff will occur. The Water <br />Quality Control Division should be contacted to determine whether or not a storm water permit <br />or NPDES permit is required. <br />6.4.14 EXHIBIT N- Source of Legal Right to Enter <br />Please provide a copy of the mineral lease from the State Land Board demonstrating Siloam <br />Stone's legal Right-to-Enter and conduct mining operations on this parcel of property as <br />required by 6.4.14. <br />6.4.15 EXHIBIT O- Owner~l of Record of Affected Land (Surface Areal and Owners of <br />Substance to be Mined <br />Under ROW's crossing the site, is U.S. West the owner of the communication ROW along Red <br />Creek Ranch Road or is it the local phone company? Please clarity who owns both the ROW <br />along with the cable and phone pedestals along Red Creek Ranch Road. <br />6.4.16 EXHIBIT P-Municipalities Within Two Miles <br />
