<br />M-97-071 <br />Page 9 <br />No Commen[. <br />6.4.17 EXHIBIT Q- Proof of Mailing of Notices to County Commissioners and Soil <br />Conservation District <br />No comment. <br />6.4.18 EXHIBIT R-Proof of Filing with County Clerk and Recorder <br />No comment. <br />6.4.19 EXHIBIT S- Permanent Man-Made Structures <br />Where the mining operation will adversely affect the stability of any significant ,valuable , <br />or permanent man-made structure located within 200 feet of the affected land, the <br />applicant may either: <br />(a) provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any <br />damage to the structure; or <br />(b) where such agreement can not be reached, the applicant shall provide and <br />appropriate engineering evaluation that demonstrates that such structure shall not <br />be damaged by activities occurring at the mining operation. <br />The Division has received a letter from the San Isabel Electric Association indicating that they <br />have no objection to mining activities around their transmission lines as long as it does not <br />interfere with the operations and maintenance of the line, however, it was not in the form of a <br />notarized damage agreement. In addition, we have not received any correspondence concerning <br />the remaining structures including the county roads and bridges, the communication lines and <br />phone pedestals, and the livestock fence surrounding the property. Please provide notarized <br />damage agreements for all structures within 200 feet of any proposed mining activity where the <br />stability of any of these structures may be adversely affected or engineering based evaluations <br />that demonstrate such structure(s) will not be damaged by the mining activities. Based on the <br />proposed mining plan, some of these structures could be adversely affected. <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />(4) Where blasting is part of the proposed mining or reclamation plan, the applicant shall <br />demonstrate through appropriate blasting, vibration, geotechnical. and structural <br />engineering analyses, that off-site areas will not be adversely affected by blasting: As <br />
