demands, suits, liabilities, damages, losses, costs and expenses <br /> (including reasonable attorney fees) which may arise by reason of <br /> injury to any person employed by Lessee on the Leased Premises, <br /> or which may arise by reason of injury to any persons or damage <br /> to any property as a result of any operations of Lessee. <br /> (d) All Saleable Materials shall be removed from each <br /> excavation to the point commercially reasonable, through the use <br /> of equipment selected by the Lessee . <br /> (e) Lessee shall reclaim the Leased Premises in accordance <br /> with the requirements of any permit issued by the Colorado <br /> Division of Minerals and Geology, or the Mined Land Reclamation <br /> Board or Office, and Lessee shall have a period of eighteen (18) <br /> months following the termination date of this Lease as provided <br /> in paragraph 3 above, or upon termination of this Lease if <br /> terminated sooner under the provisions of this Lease, within <br /> which to substantially complete reclamation; provided, that <br /> Lessee shall continue to have access thereafter to the Leased <br /> Premises as reasonably necessary to satisfy the reclamation <br /> provisions of any permit and to obtain release of any bond or <br /> security posted by Lessee in connection with any such permit . <br /> Lessee agrees to complete reclamation, within nine (9) months, of <br /> each pit after all Saleable Materials have been removed from such <br /> pit and/or such pit has been abandoned by Lessee . <br /> Notwithstanding anything else in this Lease to the contrary, if <br /> reclamation has not been fully completed, or the bond or other <br /> security posted for reclamation by Lessee has not been released, <br /> as a result of actions of Lessor, then lessor shall be liable to <br /> Lessee for costs, expenses and damages incurred as a result <br /> thereof. <br /> (f) In the event of a valid termination of this Lease, <br /> Lessee will surrender to Lessor and its representatives peaceable <br /> possession of the Leased Premises, and with such surrender, <br /> Lessee shall deliver unto Lessor a good and sufficient release of <br /> its interest in this Lease; provided, that, the surrender and <br /> release provided for herein shall be subject to Lessee' s <br /> continuing right to access to the Leased Premises to complete the <br /> reclamation of the Leased Premises . <br /> (g) Lessee shall pay when due all taxes levied or assessed <br /> against all personal property (including mining inventory, <br /> equipment, and mining improvements) placed upon the Leased <br /> Premises by Lessee during the Lease term. <br /> (h) Any use, storage, treatment, disposal or release of <br /> hazardous materials on the Leased Premises by Lessee shall be in <br /> compliance with all applicable federal and state laws and <br /> regulations . Upon termination of this Lease, Lessee shall remove <br /> 6 <br />
