review and examine the Lessee' s mining procedures and to review <br /> and examine Lessee' s books and records for the purpose of <br /> verifying the amount of production and of royalties payable to <br /> Lessor. <br /> (b) The Lessee shall forward to Lessor monthly reports <br /> showing the quantity of materials removed during the preceding <br /> month. Such reports shall be forwarded to the Lessor by the 20`h <br /> day of the month for the preceding month, whether or not material <br /> has been removed during the preceding month . <br /> (c) Within 30 days following each anniversary of the <br /> Commencement Date, the Lessee shall furnish to the Lessor copies <br /> of insurance policies showing that Lessee has insurance coverage <br /> for Lessee' s operation on the Leased Premises . <br /> 8 . COVENANTS OF LESSEE. <br /> (a) Lessee shall have the right to possession and control <br /> of the Leased Premises necessary for Lessee' s mining operation <br /> and to sample, examine, test, develop, work, mine, operate, use, <br /> manage and control the same and of the water and water right <br /> appurtenant thereto, if any, as the same may be required, and to <br /> mine, extract and remove from the Leased Premises the Saleable <br /> Material therein and belonging thereto, maintain use and operate <br /> thereon machinery and equipment and incidental structures used in <br /> connection with the extraction and sale of the Saleable Material . <br /> Lessee shall construct an enclosed structure over any and all <br /> water pumps placed on the Leased Premises to reduce to the <br /> maximum extent possible noise from said pump (s) . Further, Lessee <br /> shall assure . proper dust control is maintained at all times in <br /> connection with the mining operation. <br /> (b) Lessee agrees to cause all work, mining and removal of <br /> the Saleable Material to be done in a reasonable, prudent and <br /> careful manner and to follow and abide by the Colorado Land <br /> Reclamation Act for the Extraction of Construction Materials, and <br /> its rules and regulations, and the terms and conditions or any <br /> bond or security posted and any renewals thereof, and of any <br /> permit issued or cause to be issued thereunder, and in accordance <br /> with all applicable federal, state and local regulations . <br /> (c) Lessee shall keep the Leased Premises and the whole and <br /> every part free and clear of liens for labor done or work <br /> performed thereon or materials furnished to the Leased Premises <br /> for the development or operation thereof under this Lease, and <br /> will indemnify, save and hold harmless the Lessor from all costs, <br /> loss or damage which may arise by reason of any such liens or <br /> encumbrances attaching to the Leased Premises due to Lessee' s <br /> actions . Lessee will also hold Lessor harmless from all claims, <br /> 5 <br />
