The stored water will be calculated and recorded weekly from May through <br />September. During the remainder of the year, the stored volumes will be <br />calculated monthly. Monthly evaporation values will be based on the average <br />net lake evaporation rates shown in Table I. Weekly evaporation rates will be <br />proportioned from the monthly values. <br />5. Pursuant to the lease agreement with Darrell Camilletti, 20 acres of irrigated <br />alfalfa will be taken out of irrigated production. The 20 acres will be <br />identified in the field with the Water Commissioner. On completion of mining <br />activities in year IS, the irrigation of the 20 acres can resume. <br />6. When a valid call from a senior water right is affecting Dry Creek during the <br />irrigation season, water will be released from J.C. Temple Reservoir No. I to <br />Dry Creek, corresponding to (I) the volume of water stored out of priority in <br />Pond 006 and (2) the historical return flow from the irrigation of the <br />20 acres. The releases corresponding to out-of-priority storage shall be made <br />weekly as determined in Paragraph 4. The releases corresponding to historical <br />return flow shall be made at the direction of the Water Commissioner and will <br />not exceed the following monthly volumes: <br />May ........................ 1.7 acre-feet <br />June ........................ 4.0 acre-feet <br />July ........................ 3.0 acre-feet <br />August ...................... 3.1 acre-feet <br />September .................. 2.2 acre-feet <br />7. Peabody will construct Pond Y-I in the Sage Creek basin and will file for a <br />new water storage right. Generally, water will be available under this water <br />storage right during the non-irrigation season. A staff gage will be installed at <br />the reservoir, and water surface elevation and reservoir contents will be <br />recorded monthly during the non-irrigation season and weekly during the <br />irrigation season. <br />8. When a valid call under a senior water right is affecting Sage Creek, up to 0.31 <br />acre-foot will be released from Pond Y-I each irrigation season at the <br />direction of the Water Commissioner to replace out-of-priority depletions in <br />Sage Creek caused by pumping Well No. 1. Such replacement releases will <br />begin during the first year of mining and will continue for 20 years after <br />completion of mining. <br />IS <br />
