<br />mztcrials zs principal feedstocks.

<br />mcming Subtidc C of RCRA who raise a
<br />clzim that z certzin mzterizl is not a solid
<br />waste, or is condiuonall~ exempt from
<br />rcgulztion, must dcmonsua[c that there is
<br />z known mzrket or disposition for the
<br />material, and that they meet the arms o
<br />the exclusion or exemption. In doing so
<br />they must provide appropriate docu menu
<br />tion (such as contracts showing that a
<br />second person uses the material as an
<br />ingredient in a production process) t
<br />demonstrate that tht material is not a
<br />w~zstc, or is exempt from regulation. I
<br />addition, ow'ncrs or operators of facilitie
<br />claiming that they actually arc recyclin
<br />materials must show that they have th
<br />necessary equipment to do so.
<br />(2) It meeu an}• of the follow-ittg cri-
<br />teria:
<br />(i) It exhibiu any of the characteris-
<br />tics of hazardous waste Identified Ln
<br />Subpart C.
<br />(ii) It is listed in Subpart D and haz
<br />not been excluded from the lisu in
<br />Subpart D under §§ 260.20 and 260.22
<br />of this chapter.
<br />(iii) It is a mixture of a solid waste
<br />and a hazardous waste chat is listed in
<br />Subpart D solely because it exhibiu
<br />one or mare of the characteristics of
<br />hazardous waste identified in Subpart
<br />C. unless the resuhant mixture no
<br />longer exhibits any characteristic of
<br />hazardous wazLe identified in Subpzrt
<br />C.
<br />(iv> IL is a mixture of solid waste and
<br />one or more hazardous u~aztes listed in
<br />Subpart D and haz not been excluded
<br />from this paragraph under §§ 260.20
<br />and 260.22 of this chapter; however,
<br />the follov.'inB mixtures of solid wastes
<br />and hazardous routes listed in Sub-
<br />part D are no[ hazardous wastes
<br />(except by application of paragraph
<br /><a)(2) (i) or (ii) of this sectiorU if the
<br />generator can demonstrate that the
<br />mixture consisu of w'aztewater the dis-
<br />charge of which is subject to regula-
<br />tion under either Section 402 or Sec-
<br />tion 307(6) of the Clean Water Act (in-
<br />cluding n'astew•ater at facilities which
<br />have eliminated the discharge of
<br />wastewater) and:
<br />(A) One or more of the following

<br />- luene, meth}•1 ethyl ketone, carbon di-
<br />sulfide, fsobutanoi, D}'ridine, spent
<br />chlorofluorocarbon solvenu-provided
<br />o that the maximum total weekly usage
<br />of these solvenu (other than the
<br />n amounu that can be demonstrated not
<br />s to be discharged to wastewater) divid-

<br />listed in § 261.33, arising from de mini-
<br />mis losses of these materials from
<br />manufacturing operatioru in which
<br />these materials are used az raw mate-
<br />rizls or are produced in the mzr.utac-
<br />turing process. For purposes of this
<br />subparzg: aph, "de minima"losses in-
<br />clude thosE from normal material han-
<br />dling operations (e.g. spills from the
<br />unloading or transfer o! materials
<br />from bins or other containers, Peaks
<br />from pipes, rzls'es or other deuces
<br />used to transfer malerizls); minor
<br />Teal's of process equi~rnent, sicrage
<br />tartYs or containers; lezis from Gell-

<br />(b] A solid waste which is not
<br />excluded from regulation under
<br />paragraph (a)(]J of this section becomes
<br />a hazzrdous waste when any of the
<br />following events occur:
<br />(7J In the case of a waste listed in
<br />Subpart D, when the waste Cust meets
<br />the listing description set forth in
<br />Subpart D.
<br />(2J !n the case of a mixture of solid
<br />waste and one or more listed hazardous
<br />wastes, when a hazardous waste listed
<br />in Subpart D is hrst added to the solid
<br />waste.
<br />(3) In the case of any other waste
<br />(including a waste mixtnre), when the
<br />waste exhibits any of the characteristics
<br />identified in Subpart C.

<br />§ 261.3 Delinltion of haurdous w'asfe.
<br />(a) A solid waste. as defined in
<br />§ 261.2, is a hazardous waste iI:
<br />•- (1J II is not excluded from regulation
<br />as a hazardous waste under § 261.4(6);
<br />and
<br />(C) One of the following wastes (c) (;nless and until it meets the
<br />listed in § 261.32-heat exchanger criteria of paragraph (d):
<br />bundle cleaning sludge from the petro-
<br />leum refining industry (EPA Aaxard- (7) A hazardous waste will remain a
