<br />(i) The growing and han•esting of
<br />agricultural crops.
<br />pi) The raising of animals, including
<br />animal manures.

<br />mine site.
<br />(4) Fly ash waste. bottom ash waste,
<br />slag waste. and flue gas emission
<br />Control w-asle generated primarily from
<br />the combustion of coal or other fossil
<br />(oats.
<br />(5) Drilling fluids. produced waters,
<br />and ocher wastes associated with the
<br />exploration. development, or production
<br />o! crude oi!. natural gas or geothermal
<br />energy.
<br />(6)(i) Wastes which fail the tes~ for
<br />the characteristic of EP toxicit}• be-
<br />cause chromium is present or are
<br />listed in Subpart D due to the pres-
<br />ence of ctvomium, which do not loll
<br />the test for the characteristic of E~'
<br />toxicf[Y for an}• other constituent or
<br />are not listed due to the presence of
<br />any other constituent, and a'hfch do
<br />not fail the tent for any other charac-
<br />terLstlc. If It is shown by a wazte ¢ener•
<br />ator or by waste generators that:
<br />(A) The chromium in the waste is
<br />exclusively (or nearly' exclusively) tri-
<br />valentchromium; and
<br />(B) The wazte is generated from an
<br />industrial process which uses trivalent
<br />chromium exlcusi+•ely (or nearly exclu•
<br />lively) and the process does no[ gener•
<br />ate hexavalent chromium: and
<br />lC) The waste is typically and fre-
<br />quently managed in non-oxidizing en-
<br />vironments.
