<br />(I) A "spent matcrial" is any material
<br />that has been used and as a result of
<br />contamination can no longcr serve the pur-
<br />posc for x~hich it x•as prod aced x~ithout
<br />processing.
<br />(2) "Sludge-• has the samc meaning
<br />uscd in §?60.10 of this Chapter;
<br />(3) A "bc-product" is x mats. ial that is
<br />not one of the prima n' products of a pro-
<br />duction prouss end is not sold} or scpa-
<br />ralcl} producrd b} the production process.

<br />processed to recover a uszblc product, or if

<br />generation of spent solvents.
<br />(5) A materizl is "uscd or reused" if it
<br />is either:
<br />(i) Employed as zn ingredient (intlud•
<br />ing use zs an intcrmcdiatc) in an industri•
<br />zl process to mzkc z product (for example,
<br />distillztion bottoms from one process used
<br />as fccdsteck in zrlothcr process). Hox'cvcr,
<br />a matcrial x~ill not satisfy this condition if
<br />distinct wmponcnts of the mztcrial are
<br />recovered zs sepzrzte end produce (as
<br />whrn meals arc rccovcrcd from mctal-
<br />wntzining secondary materials); or
<br />(ii) Emplo}~cd in a pzrticular (unction
<br />or application zs an eFi active substitute for
<br />z commercial product (for example, spent
<br />pickle liquor uscd zs phosphorous prccipi-
<br />tznt zed sludge conditioner in x~astex~ater
<br />Ire2lfLCm).
<br />(6) "Scrzp mc;zl~~ is bits and pieces of
<br />mctzl parts (e.g..) bars, turnings, rods,
<br />sheets, x~ire or metal pieces that ma}• be
<br />wmbined together x'ith bolts or soldering
<br />(e.g., radiators, scrap automobiles, rail-
<br />road boa cars), x hich when worn or super-
<br />fluous can be recycled.
<br />(7) A material is "recycled" i(it is used,
<br />reused, or reclaimed.
<br />• (S) A matcrial is "a ecumulated specula-
<br />tively'" if it is accumulated before being
<br />recycled. A matcrial is not accumulated
<br />speculatively, however, if the person accu-
<br />mulating it can show that the matcrial is
<br />potentially retyclablc and has a feasible
<br />means of being recycled; zed that-during
<br />the ~ealcndar year (commencing on Janu-
<br />ary I)-!he amount of material that is
<br />recycled, or transferred to a different site
<br />for recycling, equals at least 75 perunt by
<br />FEDERAL REGULATIONS
<br />weight or volume of the amount of that
<br />matcrial accumulated at the beginning of
<br />the period. In calculating the percentage
<br />of mrnovcr, the 75 pcrccm regmrcmcnt is
<br />to b< applied to each matcrial of the samc
<br />typo (e.g., slags from a single smelting
<br />process that is rcc}'clad in the samc x'ay
<br />(i.r.. from which the same matcrial is
<br />recovered or that is uscd in the samc x~ay).
<br />h9atcrials accumulating in units that
<br />would be exempt from regulation undo
<br />§?61.4(1) arc not to be included in making
<br />the calculation. (Matcrials that are al•
<br />scads- defined as solid x~astcs 21so are not
<br />to be included in making the calculation.)
<br />Mzterials are no longcr in this category
<br />once they arc remos'ed from accumulation
<br />for recycling, however.
<br />§261.2 Definition or solid waste.

<br />(a)(1) A solid waste is an}• discarded
<br />mztcrial that is not excluded b}~ F261.4 (a)
<br />or that is not excluded b}• variance granted
<br />under §§'_60.30 and 260.31.
<br />(?) A discarded nlarerial is an}' materi•
<br />al x•hich is:
<br />(i) Abandoned, as explained in para•
<br />graph (b) of this section; or
<br />(ii) Recycled, as explained in paragraph
<br />(c) of this section; or
<br />(iii) Considered inherenrfp waste-like,
<br />as explained in paragraph (d) of this
<br />section.
<br />(b) Materials are solid x•aste if they- arc
<br />abandoned b}• being:
<br />(1) Disposed o(: or
<br />(2) Burned or incinerated: or
<br />(3) Accumulated, stored, or treated
<br />(but not recycled) before or in lieu of
<br />being abandoned by being disposed of,
<br />burned, or incinerated.
<br />(c) Matcrials arc solid wastes if they
<br />arc recyclyd-or accumulated, stored, or
<br />treated before recycling-as specified in
<br />paragraphs (c)(1) through (t)(4) of this
<br />section.
<br />(1) Used in a manner constituting dis-
<br />posal. (i) Matcrials noted with a ""' in
<br />Column 1 of Table 1 arc solid x'astcs
<br />x•hcn they are:
<br />(A) Applied to or placed on the land in
<br />a manna that constitutes disposal; or
<br />(B) Used to produce products that arc
<br />applied to or placed on the land or arc
<br />otherwise contained in products that are
<br />applied to or placed on the land (in x'hich
<br />ezses the product itself rcmains a solid
<br />x act e.)

<br />(unless used as an ingredient to make a

<br />lowing criteria to add wastes to that list:
<br />(i)(A) The materials arc ordinarily dis-
<br />posed of, burned, or incinerated; or
