6. There appears to be several creeks and ditches within the permit area. Please include <br />the name of all creeks, rivers and ditches on Exhibit C-1. <br />There are no named creeks or ditches within the permit area There is a naturally <br />occurring draw, but it is not named. <br />Rule 6.4.4 Exhibit D - Minine Plan <br />7. Please state if any existing ditches and roads on the property will be mined through. If <br />so, please state the owners/easement holders of the structures, and provide notarized <br />consent agreements to mine through the structures. As an alternative, the applicant can <br />commit to maintaining a 200-foot mining off set distance, or provide an engineering <br />evaluation to mine closer than 200 feet. <br />One access trail to an EnXco wind generator wiD be mined through. Since EnXco <br />can easily circumvent the entire mine perimeter and access that turbine by looping <br />around the east end of the pit boundaries, they have no issues with this trail being <br />removed Our proof of mailings do indicate that the EnXco Regional Manager was <br />informed of the planned pit. We have also spoken with him and have been assured <br />that there is no issue. <br />Brent Orr and I did meet with an EnXco representative, Mark Guilloz, prior to our <br />meeting with you. He is the local site supervisor. His response at the time of our <br />meeting was that the access issue was workable. <br />8. Please described all haul roads that will be utilized for the mining operation and locate <br />the roads on the applicable exhibit. Rule 6.3.3(g) requires the applicant to specify the <br />dimensions of any exiting or proposed roads that will be used for the mining operation. <br />Any improvement necessary on existing roads and the specifications to be used in the <br />construction of the new roads needs to be described in the permit and included as part of <br />the permitted acreage. The applicant will need to specify the construction methods, <br />dimensions, and the drainage/runoff conveyance structures of all new and upgrades <br />roads. The applicant will also need to address reclamation of any new or improved roads <br />constructed on site. <br />All mined material will be taken out onto the existing trail immediately north of the <br />pit boundary. This trail was built up and is maintained for access to the wind <br />generators in Mr. Schamacher's pasture. Since this road is ab~eady in existence, it is <br />not included as part of this permit. It mast remain in place daring the life of the pit <br />and rnntinue after the mining ceases to access the wind generators. That road leads <br />directly onto Co. Rd. 45. <br />All other roads will only be temporary haul roads utilized during mining. <br />They will be built as needed as s particular area is mined, then smoothed out and <br />simply become part of the reclaimed pit when reclamation occurs. <br />3 <br />
