<br /> <br />Management acknowledging that Cottonwood Land <br />holds a coal lease for the area of intended <br />exploration. <br />c) According to the NOI, some of the surface in <br />the intended exploration area is federally <br />owned. It does not appear that Cottonwood <br />Land currently holds a federal coal <br />exploration license for the area of intended <br />exploration. Please submit documentation of <br />the coal exploration license when it becomes <br />available. <br />d) According to the NOI, some of the surface in <br />the intended exploration area is privately <br />owned by parties other than Cottonwood Land <br />Company. Obtaining a federal coal license <br />will give Cottonwood Land the right to enter <br />upon these lands for the purposes of coal <br />exploration. However, the landowners must be <br />notified of the intended exploration on their <br />property. Documentation of the notification <br />must be received by the Division. <br />Documentation might be in the form of a sample <br />notification letter with copies of the <br />certified mail return receipts for each <br />landowner. Copies of landowner agreements <br />would also suffice. <br />~ ~i131~ <br />l `" ~ ~~~¢ <br />~~ <br />2) Your project qualifies as coal exploration rather than <br />coal mining. <br />3) Your project will "substantially disturb" the natural <br />land surface. Therefore, you will be required to submit <br />a bond to cover the cost of reclamation. The Division's <br />estimate of reclamation bond costs will follow under <br />separate cover. Please be advised that, after a cursory <br />review of the bond calculations submitted with the NOI, <br />the Division projects a higher reclamation cost due to <br />the following reasons: <br />a) The estimate provided in the NOI did not <br />appear to account for cost associated with <br />earthwork and revegetation for reclaiming the <br />drillpads and access roads. <br />b) The estimate provided in the NOI did not <br />appear to account for potential twinning of <br />any of the drillholes. Unless advised of a <br />maximum number of holes to be twinned, the Iv <br />Division will assume, for the purposes of <br />reclamation cost estimation, that all 47 holes <br />will be twinned. <br />~ ` <br />
