Three determinations concerning your <br />Notice have been made: <br />1j Your Notice of Intent (NOI) was found to be incomplete. <br />In order for the NOI to be found complete, the following <br />items must be submitted to the Division: <br />a) Threatened and Endangered Species clearances <br />must be received from both the US Fish and <br />Wildlife Service and the Colorado Division of <br />Wildlife. Statements from both agencies are <br />required, because each publishes a separate <br />listing of Threatened and Endangered species. <br />The NOI mentioned that the above mentioned <br />agencies are currently reviewing the NOI for <br />potential impacts to Threatened and Endangered <br />species. <br />b) According to the NOI, all of the coal intended <br />to be explored under this proposal is <br />federally owned. Cottonwood Land does not <br />currently hold a lease for this coal, however <br />the NOI indicates that a lease has been <br />applied for. Cottonwood Land must submit <br />documentation that the coal lease has been <br />obtained prior to commencing drilling at any <br />of the sites.
