• <br />In order to expedite the review process, a preliminary adequacy <br />review of the NOI was performed concurrently with the completeness <br />review. The Division's adequacy concerns are listed below: <br />1) Page 14 of the NOI states that surface outside the <br />Federal Coal Lands is private or state owned. However, <br />the surface and coal ownership table, presented in an <br />appendix, does not indicate any lands owned by the state. <br />Please clarify. <br />2) Page 17 of the NOI states that Aspen communities exist <br />within the proposed exploration area. Please indicate <br />whether Aspen communities exist on any of the proposed <br />disturbance areas. <br />3) Page 23 of the NOI states that, "In the event of mid- <br />winter drilling when the ground is frozen, excessive snow <br />would be bladed to the side without disturbance of the <br />soil." It is assumed that the excavation of mud pits <br />would still be necessary. Please commit to salvaging <br />topsoil off the areas to be excavated for mudpits as well <br />as the area immediately surrounding the drillhole in the <br />event of mid-winter drilling. <br />d <br />~~D ~ <br />~~~ <br />~b~ <br /> <br />4) The Division approves the use of suitable bentonite <br />products such as Volclay Grout and Pure Gold Grout for ~ <br />sealing and abandoning drillholes (except for a 7-foot <br />cement plug to be installed from 3 to ten feet below the <br />ground surface). These materials are preferable to <br />cement because of the reduced likelihood of shrinking or <br />cracking, as indicated. in the NOI. <br />5) In order to ensure the integrity of any monitoring wells <br />that are completed as part of the exploration program, <br />any bentonite installed below the screened interval of <br />the well should be installed with a tremie pipe which <br />extends to below the screened interval.
