You should Formally specify that less titan 70,000 tons of combined over-
burden and mineral will be removed from each site.
5. On all the seeding mixtures you must delete alfalfa since it may cause
bloat among cattle. Also, where you say pubescent or intermediate wheat-
grass, you should use both rather than just one.
Specific Pits
Fedinec Pit
1. The haul road must be included itt the permit as affected land.
2. The legal description cannot be varified - the index map is rot to small
enough scale, and there is no locate able point on the other maps. In
addition, your lease allotas you to mitre lots 4 6 5 and construct a portion
of haul road through lots ll & 12, but you do not have the right to ex-
tract anything Lrom 1o CS 11 or 12. In Cxitibit M, you state that in the
future you may mute lots 4 5 5. Does this mean you plan to mine lots 11
6 12 now? If so, you must obtain the legal right to do so either by
submitting a neca lease or a notarized letter of permission (containing
the exact legal description) from the landowner.
3. The mining plan is somewhat vague in that it does not address hoca the
topsoil will be removed, hota much could be saved, or cahere it would be
stockpiled. It also does not mention how drilling and/or blasting would
be carried eut, if necessary. You describe the final configuration,
but not how it will be achieved -the actual methods used to remove the
material should be discussed. For e:cample, how will you open the face?
Will you need storage for blasting matezials? (If so, a permit from
Division of mines would be required). Wi11 there be crushing on site?
If so, t,~here? (As mentioned earlier, a permit would be required for the
crusher; or at least a notification of relocation must be sent to the Air
Quality Control Division).
4. Your reclartatiott plan does not address the expected condition of the 40'
"highwall". I would suggest that you more fully describe the existing
conditions in relation to the anticipated final conditions. (i.e., you
might say that most of the ruck to be removed is the "toe" of a more
or less vertical slope and that the plan is to mine back to the wall and
leave it.) 'f he bench described in your reclamation plan should probably
be sloped so as to allow drainage off to the sides as opposed to over the
face. Please outline plans for such.
5. The proposed 80° slope is a new concept with which our Board has not pre-
viously dealt. IIefore I can recommend [hat the Board approve this application,
I feel it is reasonable to request that you fully demonstrate the stability
of the proposed 80° slopes through soils analyses or determination by a
