Termination of Stormwater Permit Coverage Requirement <br />i. Termination Criteria <br />a) Reclamation Permit Release: When a site has been reclaimed in accordance with the Colorado Division of <br />Minerals and Geology (CDMG) requirements and the site has been riileased from S[a[e reclamation <br />requirements, the permittee may request termination of the Stormwater coverage under [his permit. <br />ii. Request for Termination <br /> <br />When a site has been reclaimed in accordance with the CDMG requirements and the site has been released from <br />State reclamation requirements, the petmittee may request termination of Stormwater coverage under this permit. <br />The Division will consider termination of Stormwater coverage when: <br />a) the permittee has submitted a completed Inactivation Form as provided by the Division which summarizes the <br />work accomplished; <br />b All Stormwater discharges to state waters associated with mining activities have ceased and the CDiv1G <br />performance bond has been released; <br />d) The Division finds that the permittee has shown reasonable grounds consistent with the Federal and State <br />siamtes and regulations for such termination; and ~ - <br />e) Fee requirements of Section 61.15 of the State Discharge Pemtit System Regulations have been met. <br />Continued coverage may be required after reclamation or remediation has been completed if the Division has shown <br />or has reason to suspect that the Stormwater discharge may contribute to a violation of a water quality standard. <br />Stormwater Definitions <br />i. Best management practices (BMPs): schedules of activities, prohibitions of practices, maintenance procedures, <br />and other management practices to prevent or reduce the pollution of waters of the Stale. BMYs also include <br />treatment, operating procedures, and practices to control site runoff, spillage or Teaks, waste disposal, _pr drainage <br />from material storage. BNIPs include structural and nonstmchual controls. <br />ii. Operator: [he individual who has day-to-day supervision and control of activities occurring at the mine site. <br />iii. Remediation, as used in this permit, means actions taken to reduce or eliminate the overall adverse enviromnental <br />impact associated with a polhuant source. 'the term includes actions such as re-routing of swface flows, re-iocatic• <br />or a pollutant source, the addition of pollutant neutralizing or immobilizing substances, copping and~re-vegetation. <br />iv. Significant Materials inelnde but are not limited to: raw materials: fuels; materials such as metallic products; <br />hazardous substances designated under section 101(L4) of CERCLA; fertiljzers; pesticides; and waste products such <br />as ashes, stag and sludge that have the potential to be released with stormevater discharge. <br />v.
