SWMP Submittal/Review/Changes: The Division reserves the right to request and review the plan, and to require additional measures to prevent and control pollution, as needed. Upon review of the SWMP, the Division may notify the permittee at any time that the plan does not meet one or more of [he minimum requirements of d»s pemrit. After such notification, the petmittee shall make changes to the plan. Unless otherwise provided by the Division, the petmiftee shall have 30 days after such notification to both make the necessary changes to the plan and to implement them. The permittee shall amend the plan whenever there is a change in design, constructioq operation, or maintenance which has a signiScant effect on the potential for the discharge of pollutants to the waters of the Slate, or if the SWMP proves [o be ineffective in achieving the general objectives of controlling pollutants in stormwater discharges associated with mining activity. Amendments to the plan shall be summarized in the Annual Report. d. Prohibition of Non-stormwater Discharges i. Except as provided in paragraph b, below, all discharges authorized by the stormwater portion of this permit shall be composed entirely of stormwater. Discharges of water other than stormwater must be addressed in a separate CDPS permit issued for that discharge. ii. Discharges from the following sources that are combined with storntwater discharges associated with mining activity may be authorized the stormwater portion of this permit, provided that the non-stormwater component of the discharge is identified in the S WMP (see Part LD.2.c of the permit): fire fighting activities, uncontaminated compressor condensate, irrigation drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, and foundation or footing drains where flows are not contaminated. ,,. Facility Inspections Qualified personnel identified by the operator shall make a thorough inspection of [heir stormwater management system, at leas[ twice per year (in the spring and fall). These inspections must be documented and summarized in the Annual Report (see Part LE. I of the permit). The inspections must include the following: i. Disturbed areas and areas used for material storage that are exposed to precipitation shall be inspected for evidence of, or the potential for, pollutants entering the drainage system. Erosion and sediment control measures identified in the SWMP shall be observed to ensure that they are operating correctly. ii. Based on [he results of [he inspection, the description of the potential pollutant sources and the pollution prevention and control measures that are idenified in the SWMP shall be revised as appropriate as soon as practicable after such inspection. Revised control measures shall be implemented a timely manner, but in no case more than 90 calendar days after the inspection, unless otherwise provided by the Division. iii. The operator shall keep a record of inspections, including [he date of the inspection, major observations relating to the implementation of the SWMP, and actions taken in accordance with paragraph 2), above. This record shall be made available to the Division upon request and summarized in the Annual Report. E SWMP Availabilifp Upon request, the permittee shall submit a copy of the SWMP to [he Division, the Colorado Division of Minerals and Geology and EPA, and any local agency approving sediment and erosion plans or stormwater management plans, withi^ the time frames specified in the request. All SWNIPs required under this permit are considered reports that shall be available to the public under Section 308(b) of the CWA. The owner or operator of a facility with stormwater discharges covered by this pemti[ shall make plans available to members of the public upon request, unless the SWMP has been submitted to the Division. However, the pemrittee may claim any portion of a SWMP as confidential in accordance with 40 CFR pan 2. g. Annual Report The permittee will be required to submit an Annual Report, covering Jamrary t through December 31 of each year, on the overall compliance with the SWMP.
