Until such agreement is submitted and approved by the Division, Hall- <br />Irwin will need to maintain a mining off- set distance from the Ditch. If such notarized <br />agreements cannot be achieved during this review period, then a revision to the permit will <br />need to be filed in the future prior to mining closer than the approved mining off-set <br />distance. <br />Hall-Irwin commits to maintaining the mining offset show on the mining plan (and dictated by the <br />stability analysis) until the Division has approved a Technical Revision that includes a notarized <br />agreement with the ownersleasementhnlders of the ditch. It is our understanding that the City of <br />Westminster owns this tlitchleasement. <br />12. Please submit designs for the replaced ditch on the Parker property as a component of the <br />reclamation plan. Specifically, please provide estimated flow rates that the realigned ditch <br />will receive, dimensions of the realigned drainage, appropriate cross sections and how the <br />ditch will be lined to prevent scouring. <br />Hall-Irwin will submit designs for the replaced ditch as a Technical Revision. <br />13. Please state the total area of land to be affected (in total) compared with the permitted area <br />of 52.3 acres. <br />The total area of affected land is the same as the permitted area of 52.3 acres. <br />14. Please estimate the volume of overburden and topsoil that will be stored on site to facilitate <br />reclamation of the pits. <br />Hall-Irwin will not store overburden on-site. It is estimated that 23,000 cubic yards of topsoil will be <br />stored on-site to facilitate reclamation as shown on the mining plan. <br />15. The mine plan map notes that topsoil piles will be stored at a maximum slope of 1h:1v. <br />Such slopes are too steep to support vegetation. Please inform the Division as to how the <br />topsoil piles will be stockpiled to prevent wind and water erosion. The NRCS recommends <br />that topsoil piles be stockpiled at 4h:1v slopes. <br />Please refer to response #3. <br />16. The applicant references a temporary seed mixture that will be used on the <br />topsoilloverburden piles for stabilization. The Division could only locate the native grass <br />seed mixture on Exhibit E. Please clarify. <br />Per NRCS' recommendation, Hall-Irwin will use Luna pubescent wheatgrass.and/or Amur <br />intermediate wheatgrass at a rate of 15 total pounds PI.S per acre to seed the stockpiles. Refer to <br />note 13 on the Mining Plan Map. <br />17. Please describe all haul roads that will be utilized for the mining operation. Rule 6.3.3(g) <br />requires the applicant to specify the dimensions of any existing or proposed roads that will <br />be used for the mining operation. Any improvements necessary on existing roads and the <br />specifications to be used in the construction of the new roads needs to be described in the <br />
